US flexes might over RP, to keep custody of 5 GIs accused of rape

US authorities in Manila will not turn over the five American servicemen accused of raping a Filipino woman in Olongapo City on Tuesday under Philippine custody but assured they will be made accessible to local authorities.
Paul Jones, acting embassy Charge d'Affaires, yesterday said the five US Marines, who were among the 4,000 US troops who participated in a joint military exercise in the Central Luzon province, will remain under the respon-sibility of the American chancery in Manila.
“They are under American responsibility. I conveyed how seriously the US takes this accusation. We have an important agreement (that) we make them available to Philippine investigators. We made that commitment even before any charges were filed,†the American envoy said after meeting with Foreign Secretary Alberto Romulo at the Department of Foreign Affairs.
Jones stressed US authorities are also conducting a separate investigation on the case.
He added the US government will do everything it can to help ensure that justice is served if the US soldiers are proved guilty.
“Where the charges are very serious, they are innocent unless proved guilty. If they are proved guilty, we obviously find this an outrageous crime,†Jones noted.
The US Embassy, for its part, in a separate statement, also yesterday said the Visiting Forces Agreement (VFA) provides the mechanism for US and Filipino authorities to work together to determine the facts of the case and to ensure that accused individuals are available to both Filipino and US investigators, since the allegations would be crimes under both Philippine and US laws.
“The US will strictly adhere to the provisions of the VFA, and will cooperate closely with Philippine authorities to ensure that this case is handled fairly and that justice is done,†it added.
“The US takes reports of violations of US and Philippine laws by US military personnel very seriously, and will fully cooperate with the Philippine authorities in the investigation of this incident,†the embassy stressed.

ones said they have not received a formal request from Philippine authorities for access to the US Marines, who have not yet been formally charged.
Romulo said he asked the US Embassy to make sure that the accused American troops do not leave the country and that they be made available to Philippine police and judicial authorities.
He instructed the VFACOM to immediately make recommendations on additional measures that will help prevent a repeat of the “sad and tragic incident.â€
“I am deeply concerned by this report and I have instructed the VFACOM to fully assist the victim of this crime and to support all efforts by our authorities to investigate, prosecute and try this case,†Romulo said.
“The perpetrators of this heinous crime shall be brought to justice,†he added.
This is the first rape incident involving US troops that has occurred in the Philippines since the VFA entered into force in 1998.
The DFA declined to give further details on the incident including the identity of the victim.
“Philippine authorities are currently investigating this crime and we shall pursue this matter with vigor and in accordance with our laws and treaty obligations,†Romulo said.
