    Default LABOR ISSUES.. 13th month pay


    how is this computed? does absences and tardiness affect 13th month pay?

    anyone who knows someone from DOLE or a lawyer perhaps just wanna ask something?

    Our acct said that our 13th month is affected with our absences and tardiness..

    As far as I've understood, 13th month pay is 1/12 of the basic salary.. Basic salary means gross and absences and tardiness affects Net salary so how can 13th month pay be affected by absences and tardiness??

    i think it is computed on your total income (includes overtime) for the whole year divided by 12...so if daghan ka absent, i guess it will be affected, but if daghan ka overtime..mas mudaku imong 13th month pay...

    yes affected. 1/12 based on what u earned. kon ni absent ka or na late ka n gdeduct sa imo sweldo of course wla na nmo na earn so dli na part sa imo gross salary ang absences ug tardiness..

    gamay ra kaayu nang tardiness and undertime. gamay ra kaayu na og factor... ngano diay zyle, sige ka'g late or undertime sa work??

    Yes, in my company, being absent/tardy affects it, but 1 absent wont really make much difference. Got like a week or more, you will notice it.

    of course the 13th month pay is affected by absences.

    1/12 pero depending sa imong nadawat na sweldo excluding allowances, etc. purely basic pay minus your tardines and absences.

    unsay sanction aning mga company na dili ihatag imong 13 month pay? or ihatag man gani pero kulang?

                 Presidential Decree 851 :

          - provides that all employers are required to pay their employees the 13th month pay regardless of the
            nature of their employment and irrespective of the method by which their wages are paid provided
            they worked for at least one month during the calendar year.



         The minimum 13th month pay required by law should not be less than 1/12 of the total basic salary earned by an employee within a calendar year, and should be given to the workers not later than December 24 of every year.

      So meaning the 13th month pay is equal to 1 month of salary without any deductions fron absences or tardiness..... 

      Some companies violated the LAW by which they don't follow what is right among their employees ..........
