    Default Is holiday swapping legal?


    Hi guys... nagwonder lang ko if legal ba nang holiday swapping...
    For example, if holiday nato diri is June 12 and holiday sa US is July 4 and iswap ang duha... Required ang employees muduty on June 12 pero dili na sila ipaduty on July 4... But since holiday swapping man, dili na sila entitled makareceive ug double pay para sa ilang duty on June 12...

    Kung naay mga lawyers diri please share your ideas...
    And to the admins, please move lang if naay mas proper na category para ani...

    I'm not a lawyer so take my opinion with a grain of salt.

    I think ang holiday swapping is legal, kay mismo atong goberno, kusog kaayo mo swap-swap, labi na kung ma "sandwich". Pero kung ang motive sa pag swap kay para dili maka bayad og overtime pay, aw, lahi na-na.

    Either way kwarta inyong company and simply wanting to squeeze every inch of your life or wa-is lang gyud sila (liwat ni lumen). All the same, mas OK mo consult ka sa DOLE kay sila man experto ana, which is free unlike sa lawyers nga mo charge sa imo every hour.

    ^local holidays imo pasabot tingali boss...

    @TS: not a lawyer....but seems you work in a call center and mao nga ni-brought up ka ani....and most likely, di na pwede....

    Para nako TS, I think it's legal. A company may swap holidays provided na if gipa-duty mo sa Philippine legal holiday - properly compensated mo and in accordance with the law ang on top nga pay. Feeling nako Xlibris nagwork si TS kay hilig pud ug inana ang Xlibris.

    Not local holidays kay 30% ra man na... Regular and national holidays like Independence day... Curious lang jud me and murag kapoy man adto dole... hehe...

    legal ra na siya depende sa sabot... kung inyong holidays ky base sa pilipinas...ok ra na siya... if inyong holiday ky base sa gawas sa nasod..ok ra gihapon na siya... mao bitaw gitawag ug swap... ilegal if inyong holiday ky gi-swap sa rest day...

    Aw kana maoy dili legal TS. Dako kaayo na nga pagka-illegal. Sorry sa amo assumptions but you have a very similar case sa Xlibris pero if swap ilaha, double pay man dyud nuon if Philippine local holiday nagwork mo.

    Hmm... Okay ra man unta nako kay at least makaholiday sad mi... Pero feel lang man gud nako na murag gi-squeeze jud mi sa tanan pwede isqueeze...

    Ang sa amo man gud based sa gawas ang holidays but wala na mi double pay sa philippine holidays tungod sa swapping...

    ^^ dili jud double pay ky sa gawas sa nasod mn diay ang base sa holiday... meaning dili mo ka-claim sa holidays sa pilipinas...
