Default Globe Fair Use Policy 800mb limit

Hi I'm just a consumer being deceived by the company named Globe, as we all know globe has prepaid and post paid plans for Mobile internet which they promote as "Unlimited" we also know for a fact that it's not unlimited and have a bandwidth cap of 800mb/day as per their fair use policy

*this is where the fun starts*

I did review their FUP Fair Use Policy - Enjoy Your Globe Your Way and it clearly states that this fup will affect both postpaid and prepaid subscription.

Here is what the FUP states:

For both the My SuperSurf Plans and MySuperPlan All Unli Combo Plans, the Unlimited Mobile Surfing feature is normally used for emailing, browsing and base search activities. By design, this offer is not intended for file sharing software and downloading files in large format like music, videos, and movies (users of peer to peer/torrent applications). In case a customer uses the product other than its intent, the customer might experience slow browsing.

In an effort to optimize the mobile surfing experience for the majority of Globe subscribers and offer a great customer experience to all users, Globe reserves the right to slow data speeds of the top 5% of data users at high traffic and highly congested times. The vast majority of users will never experience these slowed surfing speeds and even those that fall within the top 5% be slowed by the smallest margin possible and only when the system is overtaxed. With this policy, all users will have access to the internet and only those that heavily strain the network on a regular basis will have limited surfing speeds.

Now. Please try to find in the policy that states you are limited to 800mb. Please also find in the policy that states they are able to stop your surfing privileges once you reach this said limit? I don't think you can see any.

What I do see and understand though is that they reserved the right to LOWER your speed not stop it. If you are one of the 5%. Clearly false advertisement, I'm guessing legal matters can be taken with this.

Please post your thoughts about this or if there are any globe employees please enlighten us. Cause it's clear what we can read and that's the link that you provided to us every time we hit the limit.

The 800mb daily data cap (not bandwidth cap; the two are completely different) is actually mentioned in Globe's website. Not in the link you provided, but the pages here and here do mention the 800mb data cap. As for the "unlimited" labeling... having been involved in an industry (web hosting) that also uses such superlatives in their plan names, I can tell you that usage of those terms are always very specific and always comes with a catch. In web hosting, they may promise "unlimited" disk storage and bandwidth, but the realities of what you can actually consume are bounded by other factors such as CPU cycles and RAM. Realistically speaking, you would never be able to use unlimited anything since you are limited by other things.

In Globe's case, what they were actually promising was "unlimited" browsing if (and this is a very big IF), you stay within the limits of their bandwidth/network load. That's the catch. So if, for example, all you were doing was browsing Facebook, then yeah, you can browse non-stop up until your promo expires. These "catches" are all cleverly hidden behind legalese so convoluted that they can explicitly state that their promo does exactly what they say. Unfair and misleading? Certainly, if you were the consumer. Outright lies? As far as the law is concerned, I'm afraid not. Not unless you can get a pretty good lawyer who can spin circles around their TOS/AUP/FUP.

800mb/day? grabe? di ka pwede maka DL nang movie nyan. If I were you pa discon mo switch to another ISP na walang CAP. SkyBroadband or Bayantel works great pero try to ask if aabot sila sa area mo. Thanks

This is about mobile broadband, bro. Sky and BayanTel don't exist for that.
