if you are well versed with this law sir i will give you a hypothetical scenario... what if your lot will be expropriated by the government to be made into a terminal and after a couple of years it will no longer be used as a terminal. what will happen to your lot that was expropriated?

in the interest of justice, what clause in the law of eminent domain will protect the person who at that time was reluctant to sell his land with a price that the government dictates when the land will no longer be utilized for public use?

to add insult to injury, that very same land will be sold to a capitalist by the incumbent politician at a very "handsome" price and the original owner cannot get it back because he will be bombarded by legal technicalities by the politician who "sold" the lot to the capitalist through influence peddling.

CORRECT! If I were one of the residents of Sitio San Miguel in Barangay Papas (Apas), I will just vacate peacefully and move on with my life in another lot because EVEN if they have a legal basis (which I honestly think they don't) it will be a futile legal battle when the case is already won even before it has started.

^^^ I know that you tend to be biased more in favor of the settlers but AFAIK, those informal settlers inside the camp have already violated the land donation agreement. They should have known it well before they even decided to construct their houses there in the first place. They should have known well that when the time comes that there will no longer be a camp there, they will also have to go whether they like it or not. Besides, squatting is illegal.

The land donation was intended for military use only and nothing else. and because of this violation (and the pending camp transfer as ordered by the President), the donation already defeated the purpose. that's why the Province has the right to get back the lots and use it for a more beneficial use for the benefit of its constituents. but of course, the means has to be as humanitarian as possible.

I think these illegal settlers have already been given half of the humanitarian funds. If im not mistaken, 25 million pesos was already spent for them.

^ I don't think BPO Companies pollute more than the informal settlers do.......... I'll have to say, the Government needs to solve the problem about the informal settlers (like me). A good concept would be to create highrise residential condominiums and make it affordable for the common populace, because since Cebu really lacks enough space and has a population of 800,000+ people. They can't fit if we'll use the usual subdivision type housing within the City limits. Squatters especially those near the riverbanks pollute more than you can imagine.........

but I cannot see high rise condos as feasible. That i think is only feasible for the middle class.

BPO companies per se do not significantly contribute to pollution but it is the building of infrastructures, cutting of trees, improper drainage that may destroy the environment.
problem with us is we favor too much building to sprout anywhere without even considering the environmental impact and geohazard plan.
it is more favorable to disperse development in nearby towns. that will result to more jobs in the towns and decongest the city.

what happened to the lots awarded to resident of Apas on June 23, 2003 by President Gloria Arroyo? we have to remember that the lots was declared as socialized housing sites occupied by the 1,200 families through PP 409.
there are squatters but there are also residents occupying the lot by virtue of the PP 409.
not all lots in camp lapulapu are owned by the capitol, there is a portion owned by the military.
