Cebu City-Filinvest agreement worse than Piatco: Pablo John

THE Cebu City Government’s payment of capital gains taxes and documentary stamp taxes for the sale of a 10.6-hectare South Road Properties (SRP) lot was cleared by the Bureau of Internal Revenue (BIR), city officials said.

But a day after pointing out the alleged irregularity in the City’s payment of these taxes, Rep. Pablo John Garcia (Cebu Province, 3rd district) described the joint venture deal between the City and Filinvest Land Inc. (FLI) to be worse than the Piatco contract for the construction of NAIA Terminal 3, which the Supreme Court canceled for certain irregularities.

Garcia alleged that the joint venture agreement “differed on all material points from the terms of the invitation to bid published by the City.”

In a press statement, he pointed out that the terms and conditions of the joint venture, as stated in the contract, are contrary to what was published in the invitation to apply for eligibility and to submit a comparative proposal.

Inconsistent

The invitation, Garcia said, asked for a central business district type development on a 50.6-hectare area. It also stated that FLI committed to compensate the City in the amount of not less than “P1.5 billion in cash payable within the first three years.”

But in the contract, the unincorporated joint venture covers only 40 hectares, while the 10.6 hectares was an outright purchase, he said.

He also said that the joint venture development is no longer for a central business district type development but for an integrated and well-planned clusters of medium rise residential buildings and retirement and congregate care complexes, “which is inconsistent with a central business district type of development.”

And instead of P1.5 billion being payable in three years as stated in the published invitation, Garcia said the payment period is now six years.

He said that the deviations from the published invitation directly result in, as stated by the SC in the Piatco case, “concrete financial advantages that were previously not available during the bidding process.”

“At least in the Piatco case, the contract still called for an airport terminal. In this case, it’s a totally different type of development. And Filinvest was given advantages that were not available to prospective bidders during the call for bids,” the congressman said.

He said he will dwell on this more during the congressional inquiry that he is proposing.

there is the ombudsman or the court pero di sila ganahan ana because in congress there is immunity and it will just go nowhere there. senate and congress hearings in the philippines is joke and we all know that.

PGMA has ordered the transfer of the AFP Cent Com headquarters from Cebu City to Lapu-Lapu City in Mactan Island ato pang Aug. 3, 2007!!! It's almost 2 yrs na since PGMA gave that order!

This transfer of the military headquarters is seen also to pave the way for Capitol to recover the land that is presently being occupied by Centcom in barangay Apas.

it was AFP chief of staff Hermogenes Esperon, who recommended that the Centcom headquarters be transferred to Mactan because of its strategic location.

Mactan Island was chosen as the site for the Centcom, because command centers have to be as close as possible to the metropolis.

op kors, we cannot always discount the political color involved. but the intentions of the transfer is valid and very reasonable enough...any level-minded and thinking person would too. otherwise, the order could not have come from the President herself!

But let's take note that investments for SRP is an open bid. it was just in the later part that the Council decided not to include the Province as it is not a private entity. if im not mistaken, the debates are still ongoing whether the CPVDC could still join the bidding.

call that sourgraping but there is a positive outcome about this: It gives the people the sense in the right to know about the "real" FLI transaction. The people have a right to unveil the cloak covering the FLI deal as a means of clamor for gov't transparency.

What is Suroy, Suroy, Sugbu? It is a test program which encourages local and foreign tourists to tour the ‘island province’ over three weekends, or more, by tourist bus, car and other motor vehicles in a festive caravan.

The first Suroy, Suroy Sugbu was held in 2005. The comprehensive tour plan was prepared by the Tourism and Heritage Council of the Province of Cebu and the tour operators. The mayors of designated towns and cities hosted and managed the activities. The Department of Tourism 7 and the business groups campaigned for participation and succeeded.

What does Suroy offer? It gives short town tours which showcase Cebu’s heritage and natural wonders.

Significance of Suroy, Suroy, Sugbu to EATOF

For the past three years, the EATOF has consistently emphasized the importance of developing regional tourism. There were proposals to design tourism-clusters and link travel itineraries. However, because of the absence of continuing mechanisms, the ACADEMIC committee is unable to meet after each annual forum to implement the plan.

The concept of ‘Suroy,’ supports EATOF’s perspective of re-discovering new destinations and make regional tourism more inviting and functional.

The current travel options are moving toward the direction of countryside or rural tourism. Korea, Malaysia, Japan, China, Thailand, among others, are selling un-explored destinations aside from the popular choices, like Seoul, Tokyo, Hongkong, Phuket or Taiwan. In the Philippines, a growing number of outbound tourists seek new destinations abroad and cruises have been very “saleable” for these trends. Meantime, the in-bound tourists in Cebu are likewise joining tours like the Suroy.

Countryside tourism is an interplay of ecology and heritage where nature is at its best! It situates history and culture in a wholesome, pollution-free environment and enhances the people’s aesthetic sense and camaraderie, the best gift of tourism.

Editorial: City should answer issues fully

THERE are reasons why Capitol is doing a piecemeal presentation of its questions on Cebu City Hall’s joint venture agreement with Filinvest Land Inc. to develop a portion of the South Road Properties (SRP).

One reason follows the logic of gentle rain: the better the water seeps into the soil.

Meaning, Capitol must have felt the public would understand better the issues surrounding the transaction if the questions and criticisms are done provision by provision and not given in one press con.

Another reason could have been snatched from p.r. principles (unconsciously done or intended): the longer the issue is stretched the more telling would be its effect on City Hall officials, the main target of the critique.

Challenge

There should therefore be reasons for City Hall officials to answer directly every question and criticism raised and not wallow in generalization or merely exposing alleged Capitol motives.

For one, every question and criticism Capitol people raise, if left uncontested, would have the effect of the public
considering it as true or of city officials being perceived as hiding some things about the transaction.

And if all the fuss is also about influencing public opinion, asking the people to wait until the issues reach the “proper forum,” presumably the court or Congress, is to let go of the opportunity to clarify the claims before these solidify in the public mind.

This is particularly a challenge for lawyers in the Cebu City Council considering their role in pushing for the approval of the contract whose legality Capitol officials and some congressmen are now questioning.

They should be as conscientious in defending the transaction as Rep. Pablo John Garcia is in dissecting the provisions of the joint venture agreement.

Serious issues

City Hall officials must realize by now that the issues Capitol raised against the Filinvest deal have become more serious and compelling by the day and could no longer be simply brushed aside as the ranting of a political rival.

More and more people now want to be enlightened on the actual effect this transaction will have on their lives.

MUCH has been said about the undue favors that the Cebu City Government gave to Filinvest Land, Inc. (FLI) in their South Reclamation Properties (SRP) development contract but, says a businessman friend, they are nothing that any other landowner wouldn’t have done under the same circumstances.

Pointing out how the City has unsuccessfully marketed the SRP until Filinvest came in, my friend said that the favorable treatment that the latter received was natural. City Hall must have been banking on the fact that once Filinvest started developing the portion that it acquired in the sweetheart deal, the prices of the remaining lots will go up, allowing the City to more than recover what it had lost,

But this was private business thinking, my friend said, something that the City Government isn’t allowed to have since the law bars government entities from possessing a private business mindset even when it is engaging in private business.

I can only agree. The law may sometimes appear unreasonable but it is the law.

Incidentally, until now no one from City Hall has come out to dispute Cebu 3rd District Rep. Pablo John Garcia’s assertion that under Commission on Audit rules, capital gains and other taxes as well as all other expenses of transfer of title from a local government should be borne by the buyer.

Unless City Hall lawyers break their silence and prove that the rule that the congressman cited is non-existent or has become obsolete, the only interpretation that we can make is that PJ is right. In which event, they shouldn’t waste time in thanking PJ for the reminder. Sometimes, we’re not really ignorant of the law; we just failed to read them.

Still on the row between the Capitol and City Hall, the Garcias got a favorable review from Tony Padua, a regular letter writer to Sun.Star columnists.

“(I)t is with alarm that now Gwendolyn appears in the press to be a vindictive administrator, an obstructionist to Tomas’ SRP project, when not too long ago, Gwendolyn described the SRP as a home to ‘dogs and migratory birds,’” Padua wrote.

“My take on this so far is that the Garcia family is not a vindictive clan. But long term, they are determined to bring Tomas to the negotiating table, for quid pro quo. It’s just business, Tomas knows this.”

I hope so, too, that they would soon see each other across the negotiating table and not in a congressional investigation. This thing has gone too long and too far.

Another reader, Fr. Chito Palang, a Cebuano who during the last 30 years has been ministering to the needs of the Catholic flock at the Church of Saint Thomas Aquinas in Alpharetta, Georgia, also wrote to express his disgust over the bickering.

It is a shame, the Consolacion native said, that the quarrel has dragged down the City and the Province, “preventing the positive development of Cebu.” Both the governor and the mayor may deny the last part as untrue and they may be right in saying that insofar as the delivery of basic services to the people, it still is and has always been “business as usual.”

Still that does not make the quarrel between the island’s two most powerful leaders any more desirable.
