    wa gihapon bords??... enero nman intawn tah oie... humana ang pasko, humana ang new year.. para asa man diay nah ilang 13th month pang sinulog??.. pagka dakung binuang jud ani bords... angay lng jud nga usa sa inyo ni dangop jud sa DOLE kay di jud nah mao ilang gi buhat... bisag mo ingon ka nga ngka lisod2x sila sa budget di nila i kompormiso ang kaauhan sa ilang mga empleyado... tsk tsk tsk...

    bro, pila nana ka years imong company? There are 2 reasons AFAIK why the company won't pay their employees their 13th month pay.

    1.) If they are less than a year and declares a no profit before the DOLE deadline for submission of reports.
    2.) If they declare bankruptcy

    hehehe naa ra ana nilang 2 ang reason bro. If wala gihapon then basin gi tabla mos inyong accounting firm or employer.

    Here's the 13th month implementing rules RULES IMPLEMENTING THE 13TH-MONTH PAY LAW - CHAN ROBLES VIRTUAL LAW LIBRARY

    Sec. 3. Employers covered. - The Decree shall apply to all employers except to:
    (a) Distressed employers, such as (1) those which are currently incurring substantial losses or (2) in the case of non-profit institutions and organizations, where their income, whether from donations, contributions, grants and other earnings from any source, has consistently declined by more than forty (40%) percent of their normal income for the last two (2) years, subject to the provision of Section 7 of this issuance;

    (b) The Government and any of its political subdivisions, including government-owned and controlled corporations, except those corporations operating essentially as private subsidiaries of the Government;

    (c) Employers already paying their employees 13-month pay or more in a calendar year or its equivalent at the time of this issuance;

    (d) Employers of household helpers and persons in the personal service of another in relation to such workers; and

    (e) Employers of those who are paid on purely commission, boundary, or task basis, and those who are paid a fixed amount for performing a specific work, irrespective of the time consumed in the performance thereof, except where the workers are paid on piece-rate basis in which case the employer shall be covered by this issuance insofar as such workers are concerned.


    Sec. 7. Exemption of Distressed employers. - Distressed employers shall qualify for exemption from the requirement of the Decree upon prior authorization by the Secretary of Labor. Petitions for exemptions may be filed within the nearest regional office having jurisdiction over the employer not later than January 15, 1976. The regional offices shall transmit the petitions to the Secretary of Labor within 24 hours from receipt thereof.

    Bro., this is a money-claim against your employer. Siya na ang utangan nimo, pwede na nato siya ikiha kung gusto ka. Pero kung ikiha pod lagi na nimo, andam ba ka nga initan sa imo work? Or tingali ipapahawa ka niya sa work? Mao na'y adverse nga resulta sulod sa usa ka kompanya kung mu-alsa ka against your employer. Andam ba ka ana?

    if i were u bro, u can go ahead and file a complaint against ur employer sa DOLE or NLRC. I have done it before with my previous employer coz ila gi-hold akong sweldo before ko for the cut-off before ko nag maternity leave. bisan ga labor nako atong panahona, nida jud ko ug DOLE para mo file complaints against them,inamaw ilang gibuhat,mabdos pajud ko ato...and oh the name of the company diay kay 724 care inc, its a call center in mandaue...bati kaau ilang mga patakaran...inhumane jud to ila gibuhat nko. nya right after the day ni file ko complaint nanganak daun ko...and ingon ang doc 2 days na daw ko nag labor...adto jud dayon sa DOLE aron motagam nang mga employer nga abusado!!!
