    Default Holiday Pay / Double pay

    good day istoryans.. nag trabaho ko karon and it's my first job... my concern is about the double pay on holidays... my work is all graveyard shifts (10pm - 7am). now my concern is... if holiday, siyempre, double man jud na diba? for the whole shift.. now what happens is, like for example (and this really happened?) November 1 was a holiday. Our time in was 10PM of November 1... then the next day dili naman daw holiday, so ang double pay counted was from 10PM until 12midnight.. 2 hours of working time lng.. FAET!
    diba the whole shift man unta dapat nah?

    this upcoming holiday... we were said to be reporting on dec 24 and 25, dec 31 and jan 1... yaw ko'g ingna.. tag 2 hours lng gyapon amo double pay ana?

    i'm posting this coz I want to know where to stand... k basi mag reklamo ko nga wala sa katarongan?

    thanks!

    my best bet would be to check in with your HR/payroll dept and ask them about this. that's what they're paid for.

    double pay gihapon mo ana for your entire shift.
    if you reported to work last Oct. 31 at 10 pm until 7 am of Nov. 1 then the company is obliged to pay your holiday premiums from 12 am to 7 am of Nov. 1. i think the same scheme applies for coming holidays. gawas kun rest day nimo the day before sa holiday, 2 hours (10pm-12 mn) ra gyud imong holiday pay ana. pag overtime lang! hehehe

    @klemzhou

    Do you mean to say that you worked 10pm of Nov. 1 and not 10pm of Oct. 31 until 7am of Nov. 1? Just want to clarify lang ha.

    If yes, on Nov. 1 (Saturday) you have 2 hrs. of worked time (from 10pm-12mn) and 6 hrs. of worked time for Nov. 2 (Sunday - from 12mn-7am minus 1 hr. break, if correct).

    So since Nov. 1 is a Special Non-Working Day (NOT DOUBLE PAY) as declared under Republic Act 9492, the company is oblige to pay 2 hrs. of your daily rate + 30% additional premium pay of the first 2 hrs. of work for Nov. 1. For Nov. 2, the pay is 6 hrs. of your daily rate + 30% additional premium pay of the last 6 hrs. of work as this is considered as overtime pay for a rest day.

    Btw, this is my interpretation as I've read the Labor Codes. If you have gone to your Payroll Dept. and found out that this is correct, please let us know.
