The trauma will be carried throughout the victim's life. It gets passed on to the next 2 generations. Imagine the thought when you are told one day that your mom or grandma is a rape victim, it changes everything on how you look your life and future. People's impression of that will be your father was the rapist, including your own bf/gf would think that. Even if the real father is a good man, people look down on him for marrying a rape victim. Did he marry her because he felt sorry for her? Or didn't he have any self-respect at all to look for a girl with a decent background? The rape affects everyone around the victim, not just the victim. And the irony is, none of it is their fault.
Hey, thanks for clarifying it. What I don't understand is why couldn't they bump it up to death in prison. Why give an opportunity for rapists to get out? Sorry, it's an unfair question and it's not directed to you personally
TMZ is good in shaming that mother in the show Honey Boo Boo for sleeping with a child molester. That guy got out of prison after serving 10 years for forcing her daughter to perform oral s e x on him. That daughter now is 20, so it means he did it when the girl was still 10, a minor. short story
It's shocking the mother wanted the guy back in her life after what he did to her daughter, but these things happen when you let s e x offenders get out. His story should end with his life in prison til he dies. I don't really watch that show, but it's good their network cancelled it already. Then again, they'll continue their lives away from the spotlight with that child molester around their house because of a flaw in the laws, which our constitution is patterned from.
(though I think they have a law for registered child molesters to stay away from kids, but then you can't expect the police to be watching them all the time)
Actually, rape is punishable by death under certain circumstances (see RA 8353, The Anti-Rape Law). However, due to the passage of RA 9346, the imposition of death penalty is prohibited. Thus, no person convicted of rape will suffer the penalty of death.
Death penalty has been prohibited primarily because international law abhors such punishment (violation of human rights, etc.). Since Philippines is a member of the family of nations, it is good state practice to follow the norm of the international law.
Since rape is a felony (crime punished under the Revised Penal Code), the proper term to use is not "life sentence." There is no such penalty under the penal code. Instead, Rape is punishable by reclusion perpetua under certain circumstances.
Under the penal code, reclusion perpetua has a period of imprisonment of 20-40 years. However, a convict does not necessarily have to serve the whole term of his sentence. Example, if a rapist was convicted of rape and penalized to be imprisoned for 30 years, the convict does not necessarily have to serve the full 30 years. It may be reduced under certain circumstances, nag binuotan sa prisohan etc.
There are actually good reasons and logic behind these laws. One is that makuwaan ang priso sa ato jail, which means reduced maintenance and operating expenses. Makuwaan pud og priso since nag huot na jud sa prisohan. On the side of the convict, he is also a person who deserves a second chance to be a part again of the community, to be a good citizen.
IMHO, imposition of death penalty will not solve the problem of the continued commission of rape. It is just a band-aid solution. If we really want to prevent the commission of this heinous crime, the solution starts with proper education, moral upbringing and more economic opportunities of our citizens. Except those exceptional circumstances, such as those rape committed by insane or mentally diseased person, the commission of rape is attributable to drug addiction, pornography, and immorality.
