    Default What is the penalty for rape?


    I assumed that the rapists get automatic life sentence if proven guilty, but according to this article, it's only 20 to 40 years, if not only 6 to 12 years. Those are not even enough time to recover, if ever there's a recovery in rape. Pls tell me this article is wrong and what is the correct one. Thanks a lot.


    How is the crime punished?

    The penalty varies depending on the act itself and the circumstances surrounding it.

    • Reclusion perpetua
      imprisonment from 20 to 40 years

      • is imposed on the offender if rape is committed through sexual intercourse

    • Prision mayor
      imprisonment from six to 12 years

      • is imposed on the offender if rape was committed through oral or anal *** or through the use of any object or instrument that was inserted into the mouth or anal orifice of the woman or a man
      • this may also be elevated to reclusion temporal (imprisonment from 12 to 20 years) or reclusion perpetua depending on the circumjstances surrounding the crime

    We read reports of rape everyday, then take a sigh of relief when the rapist is caught. But no one takes a moment to know how easily rapists could get out of jail. Once out, they could come back and take revenge on the victim for sending them to jail.

    I'm just bothered of the penalty for rape in general. I think it's too light. Maybe when the victim died, the rapist gets life. But what about those who attempted to rape but failed or the victim escaped before there was a penetration? It says there punishment is only 6 to 12 years. Why should the punishment of a botched rape attempt be any lesser than a rape crime that resulted in death of the victim when the intent is the same, to rape.

    What I'm getting at is, if someone have stolen a cheap phone, the punishment is lighter compared to had he stolen an iphone? Regardless of what was stolen, the thief deserved the maximum punishment.


    Rapists, like pedophiles, are likely to do the crime again. The number of victims will only pile up if our courts would keep letting them out of jail after a short time. It's not right.

    Cheers, I don't really know if the base of my argument is correct. I tried asking, but I think only those who studied law can answer it. I think I'm in a wrong forum

    What i know is rape is a heinous crime punishable by life imprisonment. But if thats d case ts, i agree with u. Siguro naay lighter punishment if fr example unsuccessful attempts & wla ra jud ma stress ang victim. But if dali ra ma free ang suspect he'll probbly attempt d act again & unfortunately basin successful na by tht time. Im not sure if na review na na nga law..
