    hello ug maayung gabie natong tanan.....

    guys na rakoi gamay nga pangutana bahin aning Bureau of Land mo question ug nganong naa gibaligya sa kaugalingon inahan sa iyang mga anak ang iyang yuta? naa man gud me yuta by which naai part nga gipabuhatan ug papelis sa akong mama nga iyaha kunuhay gebaligya nya namo sa akong manghud tungod sa kasalbahis a akong isa sad ka igsuon maong ge ingon ana nalang nya ug paagi karon naa gebaligya akong maguwang ngadto sa among hinampak sad nga silingan nga muslim(pardon me for calling names) karon iyang ge patitulohan ang katong iyahang napalit nya pag follow up namo ug unsa na lakaw sa papeles kai para makuha namo ang amoa ge ingnan man hinuon ko nga wapa daw kai nasangit daw sa bureau of land kai na qustion dw ngano daw nabaligya sa akong mama ang yuta ngari namo? naa diay ingon ana? magbuot na diay na cla ug kinsang hudasa ang baligyaan ang usa ka tao? murag it so unlikely man gud to think nga nganong gud tawn kwestionon nila nga legal man tanan papers namo? I know...I know its a legal question and it needs a legal advise bt ganahan sad ko makadungog sa inyu side about ani...please help i need a serious answer

    I think it falls with inheritance law.
    Dili gyud tingale angay e-baligya ihatag ra man tingale na.

    SECTION 5. - Legitime

    Art. 886. Legitime is that part of the testator's property which he cannot dispose of because the law has reserved it for certain heirs who are, therefore, called compulsory heirs. (806)
    Art. 887. The following are compulsory heirs:

    (1) Legitimate children and descendants, with respect to their legitimate parents and ascendants;

    (2) In default of the foregoing, legitimate parents and ascendants, with respect to their legitimate children and descendants;

    (3) The widow or widower;

    (4) Acknowledged natural children, and natural children by legal fiction;

    (5) Other illegitimate children referred to in Article 287.

    so meaning ba ani sir invalid to mga documents nga gipahimu sa akong mama sa iyang abogado?

    What document does yur mom hav as proof of ownership on these lands? (Tct, tax dec)

    Basic law in properties:
    U cannot sell what u dont own.. If u hav no title, then dat property cant be sold or bought..

    2nd query: is the property classified as agricultural? If yes, was it acquired thru patent?

    Post daw dri a copy of d title... Just delete d tct no. And owners name...
    In the deed of sale, did yur dad sign?

    walai labot akong pader ani sir kai dman ni property nilang duha as i said nasunod ra ni sa akong mama sa iyang uyuan nga nagpadako niya kai waman toi anak....naa me kopya sa deed of sale bt naa sa ako siser which is wapa naabot....title ug wako masayuo murag tua sa muslim kai ila pa sad gepalakaw aron ma subdivide tong yutaa nga ilang napalit sa akong brother

    Refer to the deed of sale:
    (Yur mom), of legal age, single/ married to ...
    If the contract indicated "married to" - yur dad has to sign since its conjugal property...

    This cud be 1 of d reason, but it'll b better if u can post a copy of said tct/oct since there cud be some restrictions or liens annotated therein..

    Dili ko abugado ha post ra ko.
