What case should I file?

Hi!

I want to sue a business for giving my expensive item to a different customer. I haven't signed any agreement since the staff in-charge did not bother to tell or remind me to do so. I believe I have the right to sue them. If you guys happen to know, please tell me what case should I file against them.

Please answer this ff:

1) did you signed a document that you are the owner of that "expensive" item?
- If no, then wala kay habol nila (see #2 )
- If yes, aslong as naka state didto nga you are the owner of that item, then you can demand a refund or replacement, or kiha nimog kawat

2) Did you paid it full?
- If no, then wala jud kay habol ana kay technically they still own it
- If yes, as long as you have the OR then you are the owner, thats the time you can file a criminal case, pangawat ang tawag ana

the idea is to established that you have the ownership of the item, if you cant established that fact... then im afraid nga wala jud kay habol ana... technically naa na silay katungod to give that item to others unless naa moy kasabutan nga pinirmihan...

you could try reading the customer protection act... naa na didto...

Do u hve a receipt from this said establishment stating the full description of ur item?

If yes, u may want to speak with their manager first if u havent done it.

Gasto mopasakag kaso & hasul pud sa imong part. at the end of da day, it's still ur call TS.

I did. I posted it here lang kay basin diay naa pud naka experience ug ingon ani ngari. Naa man gani mga post about RA 9262. Those posts helped me a lot back then.
