1 of the victims in weekend collision dies Tuesday, May 12, 2015

ARCHIE Labitad, the driver of the motorcycle that collided with a government-issued van over the weekend, succumbed to his injuries last Monday afternoon.
This was confirmed by the Talisay City Police Traffic Division.
The van, issued to the Barangay Council of Poblacion, Talisay City, hit Labitad’s motorcycle in Barangay 4 after its brakes malfunctioned.
Aside from Labitad, 14 other people were injured in the Sunday night accident.
Geron Cabanes, the van driver, is still confined in a hospital, but the other passengers sustained only minor injuries.
Barangay Captain Teodoro Belleza said he will shoulder the expenses of Labitad’s family, particularly the wake and funeral bills, as well as hospital bills.
“I already visited the morgue and the hospital yesterday. I also already talked to the driver’s family and agreed to help them with expenses,” he said.
Separate probes
To avoid plunging into a ravine, Cabanes swerved to the other lane after the brakes of the van malfunctioned, hitting the motorcycle in the process.
The family of the late barangay captain Teodolfo Labajo allegedly used to van to attend a wedding. Belleza said he could not refuse their request, out of respect for Labajo.
For that, he could face criminal and administrative charges, according to Atty. Ayesh Nogra, Department of Interior and Local Government 7 legal officer.
Mayor Johnny de los Reyes said he also plans to conduct separate investigations to determine if Belleza committed a violation.
Nogra said they expect every official to use government-issued vehicles only during official transactions and with the support of a trip ticket.
She said Belleza could be charged with violating Commission on Audit Circular 75-6 and Section 13 of the Presidential Decree 733. Both provide that government vehicles should be used “strictly and exclusively” for official business and all government vehicles must be kept in a garage, except those used in “strictly official business,” beyond office hours, respectively.
Clarification
Belleza could also be held liable for violating anti-graft laws.
But Nogra clarified that despite their authority over local government units, they cannot file charges against Belleza. Only the City Council can do that, she said.
Talisay City Association of Barangay Councils president Raul Cabanero, for his part, said Belleza must answer the allegations against him.
Cabanero, who is an ex-officio member of the council, said they can conduct a separate investigation.
