    Default Buying a lot, need advice


    Guys i need your advice, naay gi offer sa akoa nga lot, 150 sqm at 2,500/sqm. Unsa may steps to be taken para ma sure na legit ang among transaction? Unsa man sad mga fees involve in processing the papers, i heard naa pa daw bayaran na capital gains tax, kinsa man mobayad ani ako ba o ang seller? Thanks in advance sa maka share sa opinion.

    Ideally, ang Seller mobayad sa Capital Gains Tax, Documentary Stamp, Updated estate tax boss pero depende sad sa sabot labi na if Private Individual Seller. Sa Transfer of Title, murag c/o sa Buyer tasagaran.

    Under developer na nga lot? sila raman bahala.
    tasagaran set-up if under developer kay:
    1. Reservation Fee
    2. Contract Price payment (2 choices; depende nasad if naa silay deferred payment)
    2.1 Spot Payment
    2.2 Deferred Payment
    a. Equity Payment
    b. Installment Payment
    3. Move-in Fees

    if they're offering a lot in a subdivision, you can ask HLURB if complete ba license and permits ana nga developer.

    Ask for photocopies/scanned copies sa ila documents nlng such as:

    1. Land Title
    2. Updated Tax
    3. Sketch Plan

    Sa Land Title pa lang, makita nmn if under sa iyang name.

    Then, pwede sad adto sa (to follow nlng kay nalimot ko sa exact name of gov't office, hehe), basta kana ga handle bitaw for mortgage. Ask lang if naka-mortgage ba or ny encumbrances.

    Deed of Absolute Sale will do then ipa-stipulate lang tanan didto.
    - mao nmn ni mahimo nimong evidence nga gibaligya sa imoha.
    - mahal2x sad bayad sa lawyer ani

    Then, with regards to double sale (naa ny mga cases ani), ask nlng advise sa lawyer how to refrain from being a victim.

    Are you referring to Assessor's office Maam?

    Yes this is true.. you can start with the Title. CTC or OTC (Certified/Original True Copy). Diha pa lang Makita na nimo if nay encumbrances ang lot nga for sale, meaning kung naa bay laing nagclaim ani and wala pa na settle sa court..

    i secure ang dead of sale and mother title sa lot if gi buak bana
    or maybe ang tiulo jud kung certified true copy na xa and the then secure for the payments of the tax declaration tax mapping pero kung ganahan ka mas barato pa ana na value naa koy lot sa liloan calero 100 square meter ako i baligya ug 1500 per square meter txt or call lng 09324777304

    nalibog ko if sa Assessor's Office or sa Registry of Deeds kay sa Registry of Deeds man i-cancel ang Mortgage Annotation.

    and sakto sad na gingon ni sir Patrick. check if mother title pa ba or with subdivision sketch plan and naa nasad ba individual land title per slot pero usually if bag-o pa gi-subdivide and under developer, inig maimpas naman bayad sa yuta ayha pa mag process sa land title nga imong slot jud. kay what if di matiwas og bayad and ny ni assume og lain, gasto nasad.

    sa private lot, ang gihimo sa uban similar sa developer or per cut ang naay title. if two slots imoha, two land title imo makuha pra wa ny labad sa ulo bah, hehehe... pero depende rajud na sa inyong negotiation.

    kani man gud basta mortgage involve basin dako ka mabayaran ana plus interest pa
