    Default Eduardo Gullas III, friends face charges over scuffle inside club in Mandaue


    AN AMICABLE settlement did not stop the court from setting the arraignment of a Gullas scion, who is also a Talisay City councilor, and his friends over a mauling incident that happened in a bar last July 3.
    Involved are Councilor Eduardo “Digul” Gullas III, son of Gerald Anthony Gullas and grandson of former Talisay City mayor Eduardo Gullas, and his friends; and a son of the owner of the Indiana Aerospace University (IAU).

    Juvy Toring, the IAU owner, said in an interview yesterday that the conflict between his son Eugene and Digul has been settled amicably.
    He said Eugene has executed an affidavit of desistance and will no longer pursue his formal complaint against Digul.
    He said he and Digul's grandfather, Ediegul, are “barkada.”
    But a notice of arraignment has been sent out to Digul and his friends Donniko Fernan, Jed Galang and Danton Manuel Adarna, who are accused by Eugene Toring and Sylvester Garcia Ferraz of mauling them inside the VIP lounge of Liv Superclub in City Time Square in Barangay Tipolo, Mandaue City last July 3. The arraignment is set on Oct. 8.
    Eugene and Ferraz have filed a complaint for less serious physical injuries complaints against Digul, Fernan, Galang and Adarna.
    The incident was recorded in the police blotter of the Subangdaku Police Station as a physical injury and malicious mischief alarm.
    The complaint was treated as summary proceedings and bail was not required.
    Dropped
    The father of Digul, Gerald Anthony S. Gullas, was included in the complaint as an accessory to the crime, he being the owner of the vehicle that Digul used when they left the crime scene. He was later dropped from the complaint.
    In his affidavit, Toring said that someone from Digul's group attacked him while they were inside the VIP Lounge.
    "Out of nowhere, someone later identified as Donniko Fernan attacked me from behind and punched me at the back of my head," he said.
    "Before long, a group of young men rushed toward me, attacked me, ganged up on me, pushed me to the floor, choked me and beat me up several times in the head, neck, eyes and ears and other parts of my body," Ferraz said in his affidavit.
    The victims narrated in their affidavits how the accused mauled them. Their account was corroborated by their witnesses.
    Police
    "Kimberly and Eugene went ahead but Donniko Fernan and Eduardo Gullas III still continued to attack Eugene,” Ferraz said in his affidavit. Kimberly is the wife of Toring.
    In his affidavit, Toring said that the policemen responded but did not do anything "after Gullas (Eduardo III) shouted that they would lose their job if they intervene."
    "PNP Swat personnel who were already with us tried to stop them from beating Eugene but Eduardo Gullas III threatened and pushed one of them aside," Kimberly said in her affidavit.
    Kimberly identified the five Swat personnel in her affidavit.
    Roy Aldous Aizon said in his affidavit that he saw someone choking Ferraz. "Later I came to know that the attacker was Eduardo Gullas III."
    Sought for comment, Digul said it was someone from the "other group" who started hitting him with a bottle and slapping his girlfriend.
    Trouble
    In a statement sent to Sun.Star Cebu last night, Digul said that trouble started when the sibling of his girlfriend went back to their table after having gone to the rest room.
    "He was suddenly bumped intentionally by one of the attackers in the group (of Toring). I did not notice that my girlfriend confronted them so that when I turned my back to look for her, I saw her being slapped on the face by an unidentified individual. I got up and took my girlfriend behind and attempted to punch her attacker but due to the slippery floor, I was not able to hit him," he said.
    He only managed to grab the guy, he said. He also said that while they were on the floor, a woman pounded a bottle of Jack Daniels on his head twice.
    "Due to the commotion, our group went out. Then, my friends, concerned about my security, assisted me in the car and in order to avoid further commotion, we left to go home," Digul said.
    Vehicle
    Rep. Gerald Anthony "Samsam" Gullas Jr. (Cebu, 1st), brother of Digul, said the van (YCT-866) that Digul used when they left the club belongs to their father, but he was not there during the melee.
    Last September 11, Assistant Mandaue City Prosecutor Felixberto Geromo dropped the elder Gullas from the case, as no one saw him there.
    "It was an error to have included Gerald Anthony S. Gullas as an accessory to the crime," Geromo said in his motion to amend the information.
    Mandaue City Municipal Trial Courts in Cities Branch 2 Presiding Judge Carlos Fernando granted the motion.
    Clerk of Court Angelina Peralta already sent the accused the notice of arraignment, which is scheduled on Oct. 8.
