    Default Court Rulings


    Hi, as a newbie I thought I would ask the opinion of you all about RTC rulings. We own a piece of land and have all documents to prove such. Clean TCT, Deed of Sale and all Tax Declarations and Survey. Our ownership is registered in the Municipality and in the Register of Deeds in Cebu City. While we have been away as OFW's someone built on our land. As no agreement could be reached we had to embark on court proceedings. We have just been informed that we have lost our case as we were not in the country. The person who built the property on our land has absolutely no paperwork at all, but according to our attorney, paid the Judge 100,000 pesos to render a decision in his favour. Any ideas on how to proceed, we would be very grateful.

    Any evidence on the bribery? And that ruling is clearly wrong since he has no paper, on what ground can he win. Take this to a higher court.

    nag bayad mo sa tax sa yuta? I think naa na yearly na bayaran..

    pila pud mo ka-years wala ning uli or nag check sa yuta?

    Oh yeah, regarding sa tax, you can use that too. For example, if kamo nagbayad sa tax sa yuta daun sila igo lang nag squat, if mag claim sila nga ilaha dyud na then papangitai og tax reciepts kung gabayad ba sila, kay kung wala, then pede na kasuhan og evation.

    Check with the R.D. and with the archives if they really have the proper papers? if they have, then surely those are bugos coz as you have stated that you guys possesed the real ones. and lastly, check with your lawyer on why you lost the case? as our court of law decides on the merit of evidence and not on your physical presence, coz surely this is a civil case.

    the ruling is very strange...only 100,000 to rule in their favor?...they squat on your property...
    take it to higher court...

    Unfortunately the only evidence is verbal from a court appointee unwilling to testify

    AFAIK, these papers alone (Clean TCT, Deed of Sale and all Tax Declarations and Survey) could prove ownership. however, bisan naa pa nay bribery ts d mana basta2x madaog ang kaso kun ang kontra wala xay kaugalingong papel para pag probar na siya ang tag iya. basin naa pud xay titolo iyaha nga nag ingon na nawala ang tct or original title mao gi issue-han ug lain, which is kanang title nga iyang gi kuptan karon. well, your lawyer knows better so e apilar na ninyo ts.

    TS please be informative pud sah pag construct sah imong details. Unsa man reason ngano naka daug sila? change atty. ts, unprofessional move sah imong attorney is to blame bribery ngano nka daug ug d mo sulti full details.

    post unsa grounds nila for winning the case, likewise move to higher court?

    make it legal, ask a lawyer. as of now, MR or if dili puede, Appeal
