sa labor code article 95 ni state man nga " Every employee who has rendered at least one (1) year of service is entitled to a yearly service incentive leave of five (5) days with pay."

nya naay illustration...

"Illustration: An employee was hired on 1 January 2000 and resigned on 1 March 2001. Assuming that he/she has not used or commuted any of his/her accrued SIL, he/she is entitled to the conversion of his/her accrued SIL, upon his/her resignation, as follows:

SIL earned as of 31 December 2000 5 days
Proportionate SIL for January and February 2001 (2/12) x 5 days 0.833 day
Total accrued SIL as of 1 March 2001 5.833 days

So.......................

ako brother was working in this company pag Feb 2007 pa... so meaning feb 2008 naa syay 5 days... karon
so on and so forth... karon sa feb 2012 - feb 2013 naa sad siyay 5 days nga dapat unta ihatag pag feb 2013 pero nadugay man so niabot ang may 2013...
Unya niingon man ang company nga ipagamit na ang leave, dili na convertible to cash... so ni leave siya pag may 2013 ug 4 days...

ang iyang pangutana if.... kadto bang 4 days pag may 2013 covered ba to sa feb 2012-feb 2013 nga leave or sa feb 2013-feb 2014 nga leave...

Or does he need legal action to this...?
