    Default Selling an Artwork Process?


    Mga brader, naa ko question, about sa mga copyright/ownership2x stuff if mag sell ka'g imong artwork.

    Let's say nag himo ko'g painting, or drawing. Gi sell, then na sold, so ang buyer na ang owner sa artwork, nga pwede niya i-pilit sa iyang ding2x, inspiration, or ambot unsaun nya. Pero magamit ba gihapun nimo ang artwork sa imong portfolio?

    Ma sue ba nimo ang buyer if nag advertise siya sa imong artwork, but stating nga dili ikaw ang nag himo?

    Unya, eventually ang painting mu mahal na dba na sa kamot sa buyer if kibale musikat na ka as painter?

    Unya, last one, let's say, naghimo ko'g digital artwork. Gi sell, na sold. Pwede pa na nako i-upload ang picture online sa akong website?

    Murag pari-parihas ra akong mga questions, ang naka lahi lng kay digital ang ikaduha.

    I'll just give my personal opinion on this. This is only based on how far my knowledge is on this issue.

    So by copyright, you mean you have undergone all the process at the IPO? If so, kung imo gibaligya na nimo imong (copyrighted) artwork, naa nana sa buyer kung unsaon niya ang material other than plagiarise and/or call it his own. Since it is copyrighted, you have the rights to be credited in any exhibits that your work is displayed. But not the share in profits or depende sa agreement ninyo sa buyer.

    Magamit gihapon nimo siya sa imong portfolio since you are credited for it. Kumbaga ang naa sa imong portfolio is the intellectual property of your works.

    Kana if imo nang giagi sa process pag-copyright sa imo works.

    Otherwise, if wala, and someone claims your work as his, then wala na kay mabuhat ana. Other than asking him politely na itangtang sa display (physically/digitally) imong works. So kita nalang mag-bantay2 og post sa atong mga trabaho online. If you really want to put it online, then you can always put low-res ones, watermarked or put it in flash sites. Pero sa ka-maayo na sa mga software users ron makuha ra gihapon na nila, and claim it.

    One of the reasons why agencies require physical potfolio, sometimes the open files of your work to prove nga ikaw gatrabaho ana.

    All of this is the reason why big ad agencies have legal departments. To help protect their artists/designers intellectual property at the same time to make sure nga walay gi-plagiarize ang ilang artists/designers.

    That's why big companies/brands pay millions for the patent of their brands.

    Mmmmm.....so depende ra gihapun sa inyo sabot sa imong buyer noh?

    Murag gamay raman sad ang market if dili i-online ang portfolio. Lisura sad ani uy.

    By the way, what's IPO?

    And thanks i-the-mighty for answering! Do we here on PH have a rule/law about this? Maybe we can check this also online through govn't sites?

    Actually mas nindot jud kung ikaw ang mangita sa employer rather than the other way around. Risks (of abuse) is greater kung ang employer/client ang moduol nimo. Though nindot sya nga feeling pero di lang jud ta kampante.

    Please check the site. I guess design school tackles this issue man sad.

    Mahal noh magpa-copyright, and dili japun ka maka-assure nga protected imong works. Though pwede ka mukiha sa plagiarisers, it will only mean mas dako na bayad na sad.

    This is what separates the big and small time agencies.
