Hi mga people,
Just wondering about the specific legalities sa forced leave ug forced work. I did find out a link nga okay raman daw ang forced leave:
Forced Leave | Working Pinoy
Pero 2009 pa na sya nga post, I don't know kung naa na ba updates karon. While I do know nga prevention ni sya aron dili ma-close ang company, but right now here is what's going on to a certain company:
About the company: Filipino-owned company then wala nami contract kay nag-huna2x pa daw sila.
Working schedule: 9AM-7PM weekdays (originally we work 6 days a week pero nagkasinabot nga i-compress ang hours for the week aron 5 days a week ang work na lang)
ISSUES:
> Forced leaves: Mag-depende ra daw sa amo customers kung naa mi trabaho ugma or the next day. Maghuwat ra mi sa text sa amo manager kung naa ba jud mi work. Kung walay text, then wala.
> Forced work: You get a text around 5am in morning using the terms "we might have work this morning. Wait for updates". Another thing is we get a text at 8am that "we don't have work" pero makadawat ka ug text inig 10AM that "we have work coming in. Come in at 1pm" If naa mi lakaw/appointments/family matters on weekends, makadawat ka ug text ani then you are treated as someone nga walay "commitment" sa company.
> Other concerns: My contract expired a year ago then wala nay bag-o nga contract offer.
My questions:
- If they fire me, do I have a leverage to take this case legally or di nalang?
- Naa ba tay sakto nga legal rule ani para sa mga empleyado diri sa Pilipinas regarding this matter?
- Is it advisable to take this case to DOLE?
My plan is to resign this December pero unsaon nalang ang mga nahabilin nga mga employees. Our company's been doing this for the past two years.
If naa maka-advise diha, please reply lang pud aron naa pud ko lain2x nga opinions about ani. Dili lang sad sa abogado nga naay bayad (which I am planning to do so anytime this week).
Thank you for the advice, istoryans. Have a blessed Sunday!
