    Default Online traders beware! The taxman cometh


    MANILA – Online traders and entrepreneurs beware, as the Bureau of Internal Revenue this year will start going after those who fail to issue electronic invoices to customers.


    Commissioner Kim Jacinto-Henares told reporters that online businesses – such as sulit.com.ph, e-bay Philippines, alibaba.com, ayosdito.ph and multiply.com - would have to be registered with the BIR.


    "These businesses shall be registered to us, and that they should be paying the corresponding taxes. Otherwise, we will run after them," Jacinto-Henares said.


    She said even entrepreneurs who use their personal Facebook accounts for business transactions would have to comply with the invoicing requirement.


    "Some sellers negotiate directly on their personal Facebook accounts, and if these transactions are done on a regular basis, it would make him or her engaged in business, thus they also have to register and issue the necessary receipts and/or invoices," Jacinto-Henares said.


    "What happens when you buy is you receive it by e-mail since the negotiation takes place via email or online. The buyer gets the receipt of his or her purchase through e-mail, which in turn, be printed out and the buyer could keep the same," she said.


    "This plan will push through hopefully within the year. Under the rules, online sellers shall be registered as such to the BIR, and that their electronic invoicing shall likewise be registered either directly to us or a third-party accredited by us," the BIR chief said.


    "The electronic invoicing could be availed of through a third party, but such third-party shall be accredited by the BIR. Meaning, private parties could participate and get the necessary accreditation from us," she added.


    Citing Section 237 of the National Internal Revenue Code, the BIR chief said the bureau need not issue a revenue regulation to implement the law requiring the issuance of receipts and sales invoices for online transactions as well as penalties for non-compliance.

    sa mga online sellers unsay take ninyo ani?, im currently selling a laptop on B&S should i issue a receipt to who ever gets it?

    the reason of some sellers to sell online is basicly tax, now this... will istorya's B&S be included since they include sulit which is basicly not the seller but just the platform where to sell... imagined selling 1 item just to free up some space of your closet then you have go thru that b$...

    Well, ideally, nindot siya but in reality, just another BS in my opinion.
    Why tax those retail traders, even online, and leave those big fishes unattended. Huge investors are paying way much lower tax rates than ordinary people.

    I hope that BIR will first fix their service before coming up with things like this. Nindot unta but again, how are they going to implement this properly, efficiently, and fairly?

    If b&s transactions are done "on a regular basis" ra man kaha... dili siguro apil atong pagbaligya-baligya og things nga panagsa ra.

    In most countries man siguro, if naay regular buy & sell transaction even if it's online, it's considered as business transaction jud and is therefore "taxable". Ang pangutana, makagukod ba jud sila ani ?! Bisan gani developed countries, dili man gani maka-fully implement ani. I just hope jud dili ni magamit as a reason for our Gov't Agency Officers aron makapangotong!

    For those with regular business nga mo go online (like hotels, online grocery stores, etc), ok ra na.

    As always, the real concept of taxation is good man jud. Kay ang tax god ang mopadagan sa gobyerno.
    Ang question lang is gi-follow ba jud ang tinood nga concept.

    Unsaon kaha ni nila pag implement.

    Naa silay data on pila ka online traders currently operating? Pila ka online shops? wala man gani cuguro, mag tax pa hinuon. lol

    Next nila taxan ang mga homebased workers earning online. hays

    well, good luck! can't even implement laws on sidewalk vendors flooding the streets... tax them first before you tax discreet online business that doesn't even use the government resources.

    arong ingnon naay nahimo ang BIR? hahaha.. good luck sa pag trace sa mga online businesses.. Mura man ni silag nag himog software sige add new features nya ang kato karaan na features daghan gihapon bugs.. mao gihapon failure..

    i see one option to implement this without going one-by-one, is they will asked the host site to charge seller then bir will collect from them.... like they could charge sulit on all transaction done on their site then sulit will then charge all the sellers transacting on their site... possibility yes... chances? very slim... but possible...

    posible ng imong option bai salbahis pero unsaon kaha nila ang namaligya sa fb og online forums and other sites nga walay checkout features. labi na ng meet-up2x style...
