REcently naka experience ko on a Citom Smoke emmision check point.
Now first off i want to let you know that im very much a green environment consious individual.
I drive a diesel powered vehicle. We use it to haul our raw materials, finish products etc. Recently i was in a big rush to deliver goods to meet up a critical cut off time by our forwarder. I was hauling a heavy load maybe 600-700kg which caused my engine to run hotter than usual. It was also 3 months since my last oil change tune up.
As i was traversing V.rama just past Girls high a individual in the middle of the road wearing a plain blue shirt stopped me and commanded me to pull over. First instinct ko was to hesitate. Why there was no way to identify that he was citom. I only noticed a dilapidated van and 2 other individuals there that i suspected they were in fact citom but still doubtful.
Next thing i knew it was that they told me that i had to have my emmision checked on site. I asked why? They replied my smoke was black. then one person suddenly opened my door
WITH OUT MY PERMISSIOnI immediately grabbed the door handle to prevent him from opening the car and entering. I then closed it again and asked " Hoy doh unsa man na imo ge bohat ?" He replied "ato i test imo awto sir kinahanglan ko mo sud para mo operate" I looked about and asked. legal ni inyo ge buhat?? He replied evasively and said " Sige na man mi ani sir" This was not the answer i was looking for. I asked again " Di ba kung mu harang mo og checkpoint kinahanglan man na Klaro mo nya duna jud Police mu kuyog?" Again he said "Di man sir sige nami ani"
I was so hesitant i could not do anything i have stock that i was in a rush to deliver. They would not give you a chance to think. Then they throught the small almost maybe just 1/4 window opening shoved a metering device in the dash. I did not want to make a fuss but i had to make sure this was not a hold up. then i noticed the device was plugged to a computer in there van. I was really hesitant but as long as it was not a hold up. i finally allowed them in my car.
My question to the legal experts who could read this.
1.) is this legal?
2.) Is not a private vehicle considered extension of ones home and anybody forcing to enter tresspassing and punishable by law?
3.) Had i declined them entry would they have the right to force the test. Or would a test even occur?
4.) Di ba dapat jud duna police kuyog ani kay who is there to protect my rights
Duna pa jud sila papil gepakita nako gamay ragud maybe 2 by 3 inches and had the words warrant written. I dont have this now among the papers they left me. Intriguing kaayo kay di ba huwis raman ka isssue og warrant. And if so ngano ge bawi man nila wa gepadala sa instructions for compliance. I hesitated posting this part of the story kay wala naman nako ang ebidensya.
FYI na hagbong ako awto sa ila test pero 6 points ra jud ang deperencya. Comliance was accomplished simply by quick tune up. Which would have been done the month after as all this occured when i was 3 months since the last tune up.
Im all for taking care of the environment. Its the handling of this incident that bothers me. Kay what if duna mga Unscrupulous person my try of duplicate ani nya the minute masulod sila sa awto i dagan dayon or worst birahan pata. Medjo HUDLOM bya kaayo mga nawong sa ni para.
