So yesterday - June 15 Wednesday, Me and my bf went to meet the landlady in the Baranggay Hall.
The Baranggay Captain got the complainant (her) to talk first and then us.
It was loud and clear that there was no case of oral defamation or any form of insult or offense.
Even the Baranggay Captain agreed that there was no point of us being there.
Why?
1. The conversation between me and her was through cellphone. (that is not public humiliation)
2. she tried to dig in more but i have all the evidence that she misunderstood what i said and it was loud and clear through text that i told her i did not say anything to insult her.
3.She ended up being trapped in her own words. (meaning she lied and could not straighten up her words)

Now before she explained what happened, she mentioned that she has been lving in Talamban for 25 yrs and that she is a good friend of the Brgy Captain.

So when it was my turn to speak - i told them that first of all - Regardless of how close you are to the BRGY Captain, it had nothing to do with the case. We are hear to settle this so the basis has to be the truth and thats it.
-The Brgy Captain nodded his head so I thought we were on the sale page of the book.

After us talking, I was expecting the Brgy Captain to let us know what his point of views are and try to settle things yet he did not do it. No reaction at all - apart from him saying we are going to proceed to LUPON?

WTH is that??
The reason why we came there is for us to get an agreement that we are going to leave the apartment by the end of the month (although we already plan to leave this weekend) and just give our deposit back which is 24k.

Who ever I ask - They say the same thing to me- that it was BIAS! and that since it was clear enough that there was no problem, then he couldve settled it there. He did not even ask us what we wanted to do. We asked the landlady whats the point of doing this "she said I dont know... so my BF replied - Us too! we dont know cos we never did anything bad to you!
But since the BRGY CAPTAINS "FRIEND" wants to proceed to the next level.. NO QUESTIONS ASKED... AND HE DID IT. Instead of having an agreement.

We did not want to make a big issue out of it and just leave as its obviously such a waste of time.

where there any kind of written contract saying that you can't get your deposit back? if wala, then iokay have an attorney. Clearly they are just making fun of you. What they need is a lesson.

The problem now is that my BF is not sure if she gave the copy of the contract to him as he could not remember it. We've been asking for a copy of the contract again now but she doesnt want to give it to us because she already handed it to her lawyer.

Regarding the forfeited deposit - She got us to pay the rent 6th of June, instead of letting us know she wants us out of the apartment. She gave us a letter from her lawyer stating that she wants to raise the rent and unable to response after 5 days upon the date it was made would mean we dont want to renew the contract anymore. She handed it to us 6th of June and it was dated 30th of May . So we did not have the chance to talk to her about it.

but if you want to pursue the case better look for a lawyer puede man na nimo siya ma counter og kiha file pod mo og kaso. kana kong anad ka og gobot, hehe. taxing kaayo na sa mind og body TS.

Trabaho baya na niya - dili nya dapat i personal ang situation.
We did not want to pursue the case which is the reason why we came there. Kay first of all THERE IS NO CASE.
