    Default Need advice from expert on real estate (or lawyer)


    Naka downpayment ko ug subdivided lot somewhere in the province. Ang original sabot namo sa developer (verbal ra) more than a year ago, nga upon full payment iya na ehatag ang land title. Actually, even siya ang developer, dili siya ang owner sa whole lot, pero limpyo naman kuno ang agreement, wala palang na subdivided ang lot.

    Then lately nagka storya mi sa developer, ingon siya nga after two years pa ang land title mahatag. So if ma fully paid nako, tagaan langsa ko ug Deed of Sale or other contracts (except the land title).

    The question is, pwede raba na nga Deed of Sale lang muna ako dawaton, then mag wait ko sa land title? Or the Deed of Sale will not hold value in comparison to the Land Title which I don't have yet?

    I am concerned na what if ma fully paid nako, then all of a sudden, naay instances nga ma change ang mind sa owner.

    (example, ang original developer nga ako ka contract, mamatay. Then ang original owner pod kay mamatay, ang heir to the land will not sell it anymore. Then wala raba mi pinirmahan between nako ug sa original owner, or sa iyang future heirs. Basing sa ako minor knowledge sa Obligation and Contracts, ang contract cease to exist if one or both of the contracting parties are deceased.. please correct me if so.)

    Please I need professional or legal advice regarding this matter, or with persons nga naanay experience in this area.

    taa2x pa ang buhaton anang sa imo boss. and kanang imo mga agam2x, tinood na.

    una: before ka unta ningpalit, you could have checked the pertinent papers of the said property. like the developer is not the owner of the said lot, have you seen the deed of sale of the real owner unto the developer? or the MOA between the developer and the original owner/s, SPA, or any document to prove the authority of the developer to engage into contract using the said lot? para naa kay hold mag inkaso man.

    ikaduha: the partitions or subdivided lots should be duly approved by the Bureau of lands. this is one of the requirents later in processing your title.

    ikaupat: make sure the real property tax of the said property is paid up to date.

    ikalima: dapat naa jud mo written agreement with your developer, dili lang verbal.

    now, kung ang developer nimo ang mag process sa title. madugay pa jud na labi na kay wala pa na approved ang subdivision plan. so most likely, kanang imo gigunitan nga document is merely a contract to sell or a contract of sale, dili pa deed of absolute sale. make sure lang kung maka fully paid naka, have a confirmation of sale or a deed of absolute sale pa gihapon.

    kung naa jud right ang imo developer, mo stand ra na imo contract maski mangamatay pa nang developer or original owners. kung i-rescind ang contract, aw makakiha jud ka pero gastos na sad.

    get the clear status of the property. kung dili ka satisfied, you decide.

    ilang gi recommend nga dapat moagi ug bangko para sila na mo verify if valid/transparent ang transaction.

    Actually, nagka storya nami ug balik sa developer. Naa man siya special power of attorney gikan sa owner. Then if ma fully paid nako even if wala pa land title, tagaan ko unta ug Absolute Deed of Sale.

    Maayo nalang ne offer cia nga pwede ra magpa refund nalang ko if dili nako interested sa yuta. Nagka sabot nami, then iya ra e return nako ako money in full amount within six months...

    Be it a lesson for others also who have plans to purchase a land... thanks!
