Change in Name of an Illegitimate Child upon Marriage of Parents The Supreme Court of the Philippines has ruled that a child will carry the surname of the mother if the child’s natural parents are not married. Should the parents of the child validly marry each other after the child is born, the child may be legitimated. As a legitimated child, he/she may carry the surname of the father.
Legitimated children are defined as illegitimate children who, because of the subsequent marriage of their parents, are considered legitimate. Legitimated children must possess the following requirements –
- the child was conceived and born outside wedlock
- the parents, at the time of the child’s conception, were not disqualified by any impediment to marry each other
- the child does not come from an adulterous, incestuous or bigamous marriage.

2001 RA 9048 amends Articles 376 and 412 of the civil code of the Philippines, which prohibit the change of name or surname of a person, or any correction or change of entry in a civil register without a judicial order. Administrative Order No. 1 Series of 2001, implemented the law. It authorizes the city or municipal civil registrar or the consul general to correct a clerical or typographical error in an entry and/or change the first name or nickname in the civil register without need of a judicial order.
