Under the Friar Lands Act, the plaintiffs believe it is the Cebu City Government that should determine what public use the friar lands can be devoted to, and not the Province, even if the latter is the registered owner.
Citing the Urban Housing and Renewal Act of 1992, the complainants said the fate of Barangay Apas belongs to its residents.
Also, they said the transfer of the Central Command in Camp Lapu-Lapu, Barangay Apas to pave the way for a commercial venture violates the Friar Lands Law.
