    Default need your advice....


    i am posting this for a friend.

    when he started working for this company he didnt recieve any sss,philhealth. he was also promise by the company that he will recieved overtime pay and a salary of 7000. after five months of working, he always make it to a point that every time he recieve his salary to complain, " where is my contract ready, my salary adjustments,my overtime pay to be adjusted, they say that the salary is monthly, yet it is computed on a daily basis not including saturday. when there was work on a saturday. they say that it was already included so on and so forth. so he was so shock to recieve verbally from the owner that he is terminated right then and there.

    my question is? is the company practicing illegally terminating its employees? what can we do about this? i pity my friend who is now having no work.

    well, there are rights governing labor.
    as for ur friend was he given a payslip everytime he receives his salary?
    it's very important that he kept it, so there will be a proof that he worked there since he was not able to sign a contract

    he has a right to go after the company. since he has a payslip and he did not receive any termination papers.
    there was no memo of any infraction he committed that caused his termination...

    he was told to write a resignation letter, which of course he did not. where should he go?

    but they say if you work less that 6months you cannot or dont have any chance in department of labor.

    [color=navy]Who says? Better get it from those who really know, and I think the best source of the right information is from the Department of Labor and Employment. There's no harm just calling and finding out, right?

    Or if you would prefer, you can request assistance from the media regarding this issue, especially from the public service AM radio programs on DYAB and DYSS. Your friend can report this wrongful termination to the media.

    i called up my friend just now, he told me that many people in the office think that he voluntary resign, which he told that he did not resign. and he is still waiting for the resignation papers which they promise to give to him.
