After reading this (Palace advises Chiong | Sun.Star Network Online) and other news articles regarding this issue, it's really a pity that what batigol192002 posted in this thread is right on the spot: The Philippines is a banana republic.
What the heck is Malacanang saying? They leave it with the DOJ? Are you telling us you're a lame duck administration or you're an administration that has been paid to do the transfer?
If Paco is indeed a Filipino citizen, then whether he's a Spanish citizen or not does not matter. He was born here and he lived here. How long has he actually lived in Spain? The Philippines should assert its sovereignty. Why does that treaty even apply? There is reason to apply the treaty for Spanish citizens who are really NOT Filipinos. It's not a problem if they are sent back to their home country. Just like if a Filipino citizen committed a crime in Spain, then he can be sent back here. If the person is both a citizen of Spain and the Philippines, why the heck are we saying that he should be treated as Spanish first, Filipino second. The crime was committed in the Philippines against Filipino victims by Filipino convicts. Why involve Spain? Can we cut that guy in half and send the other half to Spain? Or since the Chiong sisters had Chinese ancestry, we can send this guy to be tried in China instead? Will that be better as he can be executed through firing squad in China? This country needs to assert its independence and not make a mockery of itself.
Why is PGMA to blame? Because she can do something to stop this mockery but did not. Or maybe she is part of this whole thing. Spain did not even ask for this guy to be sent there. What transpired obviously is orchestrated by someone high up in the administration. It's actually not the Philippines reneging on the treaty. It's actually the Philippines trying to force Spain to accept this guy because there's such a treaty. Spain is not even sure he's one of their citizens yet!
Maybe it was during Erap's time that the treaty was signed. However, it's almost EU policy to have such treaties for countries that have the death penalty, which the Philippines had during that time. The motivation for the EU countries was that their citizens not be sent to death row or that they would not be caned or tried under Sharia laws in other countries. The Western countries think that Michael Fay should not be caned when he committed vandalism in Singapore. But Singapore asserted its sovereignty and applied its laws even to American citizens. But now, the Philippines is transferring to Spain one of its convicts as if he is not even Filipino. Unya para ma carry out ang treaty, bayaran ug 12,500 euros? Which is actually less than PGMA's one-night dinner at Le Cirque? Na-unsa naman intawn? Bayaran ninyo ang 2 ka anak ug less than a Le Cirque dinner? Kabaga pud tawon ug nawong oi nga mao pa na inyong ipagawas sa press nga "advice"...
