if i may add, the opposition during Erap's time was not as hungry for power as the current opposition we have.

it's not PGMA who sucks...but the politicians who are still vying for her throne as the president...until now they are still hoping to steal the position from her...people should not compare estrada to gma...they are not in the same level...gma is way too intelligent and got more sense than erap...

EO 464 does not really prohibit the members of the executive to appear in any inquiries, the order only required these people to ask clearance from the President before appearing in any inquiries.

apparently, what drive the senate and even people from congress including president's allies is that the prohibition of executive officials from appearing before any legislative investigation without her permission must have fairly enough vertebrae from the current provision of our constitution.. implying a direct slap on the congress, which is so impolitic for a president..

constitutional reliance of such order was more likely basing on provisions which, i dunno if her advisers are aware at, have been slightly modified..

old provision.. purely dependent upon the president’s consent:

“The heads of departments upon their own initiative or upon the request of either House may appear before and be heard by such House on any matter pertaining to their departments unless the public interest shall require otherwise and the President shall so state in writing.â€�Â*

current provision:

"The heads of departments may upon their own initiative, with the consent of the President, or upon the request of either House, as the rules of each House shall provide, appear before and be heard by such House on any matter pertaining to their departments.�

the stressing of “orâ€� reflects two scenarios when the department heads may appear before legislative inquiries.. when they do so upon their own initiative with the permission of the president as a prerequisite... while another scenario is when their appearance is requested by the house of congress,Â* notwithstanding any express consent from the president.. i think a modification in the charter was intended to reduce the executive powers that marcos abused before..

bottomline, no public official/officer will testify in any inquiries unless he/she talks first with GMA

commonsense suggests that by instinct we are compelled to cover our assess in any way we can.. and giving somebody who’s involved in the issue a direct or indirect influence on the development or outcome of it.. then expect biased to play a role on it..

seems like as for the president she is very willing to do so.. even if she would have the nerve alienate congress and the public’s right as well - by meddling with the functions and powers of a co-equal branch of the government and smothering freedom of expression and the right to information of the people in general.. ()

@FK: yeah, transparency is always good, but look at how the senators cross examine the supposed to be accused and witnesses, is it right to attack people personally by saying that they are pimps and are not fitted for the position they're holding. their lawyers couldn't even object. it's all wrong, this hearings should be done in court. have you ever been in any court hearings FK? in a real court, the accused eventhough its clear to everybody that he's guilty, is given right to defend himself legally and must be given utmost respect until proven guilty. the senate hearings are like guerilla hearings, they attack a person with statements irrelevant to the topic. if you were in their shoes you'd feel uncomfortable and deprived of your basic right as a person.

but it's just a investigation... and the witnesses, accused or whoever is called in the senate still has the right to bring an atty. I believe, the lawyer of Sandra Cam was even cited for contempt in the senate. Yeah attacking the person personally is wrong but should it be stopped bec. only one person compared the person as a pimp. Should this be a mere basis to disallow person to participate in hearings...
