    naa ko kaila nga giingnan sya sa iya employer nga gamay kaayo iya rate sa evaluation then naa daw sya work attitude problem.. so gitagaan sya ug option sa boss niya (1) to resign (2) or iterminate sya.. syempre resign nalng sya aron, nindot pod iya dungog.. u think, ok to sya nga move sa employer?

    murag iterminate na gyud to siya from the start, pero maglisod man tong employer ug terminate if ang basis niya kato ra evaluation, lisod pag justify, so wala unta to mo resign.

    so ngisi ang employer pag resign, wa nay sakit iya ulo.

    i think i just found the best solution. The best way to do it to ask advise from DOLE.
    Before terminating the employee, talk to DoLe first on what you are about to do. They will give you alternatives and legal advices. They will guide you on what should be done. How to avoid pitfalls, and best of all, how to avoid the court cases.

    bro what are your intentions of terminating an employee? based on your previous posts, because of cost cutting measures..

    hmmm bro there are many ways to kill a cat, if your problem is cost and want to reduce labor cost then go for reduce work sked. pa work imo mga employee 3x-4x a week instead of 6 and everyone shares the burden. always have the mindset of protecting your best asset which are your people.Implement this until mo improve na inyo situation inyo company. many big companies are doing this.


    i would agree in terminating unproductive, slack employees. but you have to do this in progression. 1st offense verbal warning, 2nd offense written warning, 3rd offense suspension, 4th offense more suspension, 5th offense dismissal. make sure you handle it in fair and just maner. check out your code of conduct.

    check for redundant positions and file for redundancy..refer to DOLE regarding this one coz na a na steps e follow. Dole has to be aware.

    actually not only in labor you can save, check out productivity, machine downtimes, wastage, etc. you can find a goldmine their. You can even provide incentives for employees who provide good suggestions. i remember before, we have a very simple solution (w/o adding cost) and it helped saved the company 300K per month. not bad for a zero investment suggestion.

    There are a lot of methods being applied by different HR's of the company. But all this depends really on different situations. The best way to terminate employees is to observe what the law requires, which is due process... Where an employee commits an offense against company rules then... take note provided you have your own set of company rules... if there is none... Labor Code also has some grounds for terminating employees.. Kindly check on that...

    Further, there are ways of terminating them through Economic and Non-Economic reasons... for Economic reasons this is through Retrenchment... for non-economic reasons through offenses or violation of company rules, as well as, the labor code.. Nowadays, even if you terminate your employees through a legal manner, still labor accepts whatever complaints being raised by these employees.. Its up for your lawyer to provide evidences that would justify the dismissal as valid...

    kung badlongon nga employee imu gusto i-terminate, build a case usa para safe ka sa legal implications... build a case would mean kada sayop buhatan nimu memo unya i-apply dayon ang company policy

    yes, how to terminate an employee in the philippines? Is there such law that protect employers with employees who are not non-performing anymore?

    hi the best way is to read the labor code of the Philippines... and do some research to avoid court cases....
