    non-bailable offense is actually non-existent in the strictest terms. the gravest offense is bailable provided the evidence is not strong, otherwise one could just file a baseless charge against his enemy and charge him with a grave offense to ensure that he gets imprisoned with no possibility of bail.

    in enrile's case, the supreme court let him off mainly for reasons of health and no flight risk. in my opinion, if enrile is to be released, the reason should be based on the evidence whether such is strong or not and not on any other ground. however, the supreme court voted 8-4 in favor of enrile. im not at all suprised that the supreme court justices who voted for enrile's release were all appointed by Gloria Macapagal Arroyo. so you see, even as now, we are still haunted by the influence of gloria's corruption.

    in granting enrile bail on grounds of compassion for his advanced age, it's as though the supreme court extended enrile judicial clemency, which is a prerogative reposed solely on the executive branch/ president. only the president can do that, and only after final conviction.

    Well, Enrile might be old, but he's not frail or sickly. He still has the ability to sign documents, destroy any undisclosed evidences and transfer Peso to Dollar Swiss accounts within hours. Second, the evidences are way too strong against this Plunder case. Which is why bail is no longer applicable. Third, any future case involving a geriatric defendant aged over 70 will use this doctrine to get bail.
    These 8 Justices don't have any single clue what kind of judicial catastrophy they've just unleashed.
