The whole Simala affair has spawned many issues:

1. The Libel Case: This is about the alleged malicious publication in Lungsoranon on the circumstances of Bro. Paul's dismissal from the monastery which discredits him. Proper forum: Fiscal, Court.

2. Allegations of deception with respect to faking of miracles and cashing on these fake miracles.

Proper forum No. 1: The Archdiocese. It has the duty under church rules to investigate in its own initiative to find whether the claimed miracles in Simala are authentic or not, using scientific, medical, theological, psychological knowledge. It has to officially declare whether the miracles are WORTHY OF BELIEF and that it officially allows some form of VENERATION of the statue.
This is a safeguard against IDOLATRY. Without their investigation and findings, the believers COULD ONLY BE WORSHIPPING a man made idol. From the start and until now, NO INVESTIGATION HAS BEEN CONDUCTED and NO OFFICIAL PRONOUNCEMENT AS TO THE AUTHENTICITY OF MIRACLES have been made by the archdiocese.

Proper Forum No. 2: The Vatican through the Sacred Congregation of the Doctrine of Faith. It has the power to investigate even the bishop with respect to miracles under his diocese. The bishop himself, if he really wants to clear up the confusion or A QUALIFIED GROUP OF CATHOLIC FAITHFUL can demand the Vatican intervention. The Vatican can declare with finality that the whole thing is a fraud and can impose canonical punishments on the culprits, OR DECLARE THAT THE MIRACLES ARE AUTHENTIC AND THEREFORE WORTHY OF BELIEF AND VENERATION. This is good because it would clear up everything once and for all.

Proper Forum No. 3: FISCAL, THE COURT. Faking miracles to the damage of fooled believers is a form of swindling and is therefore a CRIME. If Bro. Paul can prove and has enough evidence that the whole Simala affair is a hoax, then he should sue the monks along with fooled believers for swindling. Judiel Nieva's miracle was exposed to be a hoax. He walked away a millionaire just like that without being punished. While a person can believe on anything in the exercise of his religious freedom, it is a crime to falsely and fraudulently invent a miracle to gain money. Otherwise, it would mean its okey to commit fraud and deceit as long as they are committed in the name of religion!

3. SODOMY AND IMMORAL CONDUCT: Not a crime because Bro. Paul admitted that he gave in to the temptations of the flesh. But if he was forced to submit himself, it could be a SEXUAL CRIME depending on what was really done to him. Otherwise, the proper venue is the ARCHDIOCESE OR THE VATICAN. The finding during the investigation should be related to CANON LAW with respect to disciplining or dissolving institutes of religious life .

THE FINDINGS MUST BE RELATED TO THE CLAIMED MIRACLES because COMMON SENSE DICTATES THAT IT IS SPIRITUALLY AND THEOLOGICALLY IMPOSSIBLE FOR IMMORAL PERSONS TO BE GIFTED WITH A HOLY AND DIVINE MIRACLE THROUGH THE PUREST AND THE IMMACULATE VIRGIN MARY. Venancio Cabillon, a.k.a. Frater Paul Mary, took the unprecedented move of suing no less than Ricardo Cardinal Vidal for libel. He claimed, in the complaint he filed with the Provincial Prosecutor’s Office that the cardinal and three others maligned his reputation by publishing in a Church-based newspaper a notice that Cabillon has been dismissed from the Marian Monks Monastery in Simala, Sibonga for, among other reasons, violating the vows of chastity and obedience.

Frater Paul Mary admits that he is gay and has committed lascivious acts that he did not elaborate. At one time, he said, he participated in a Miss Gay contest inside the monastery. He probably wouldn’t have sued if the notice merely said that he was terminated for being neither so gay nor so beautiful, having placed only second in the beauty pageant.

Cabillon is clearly on the warpath. Because cardinal Vidal did not bother to get his side and, later, refused to apologize for the omission, he has decided to expose supposed shenanigans inside the monastery to give his tormentors a “dose of their own medicine.”

But it will not shrug this scandal off unscathed.

There will be defections to other religions and for those who remain like me would go for purging and cleansing of members who lead people to heresy and idolatry.

CEBU Archbishop Ricardo Cardinal Vidal and three local Church officials were directed to submit their counter-affidavits on the libel charges filed by a separated monk last Friday.
Asst. Provincial Prosecutor Gerome Abarca, one of two prosecutors handling the case, said subpoenas were issued to the archbishop and three priests amid the preliminary investigation into the case filed by former monk Venancio Cabillon.

This came amid reports that two monks went to the Cebu Provincial Prosecutor's Office to fill sworn affidavits in relation to the case.

But Provincial Prosecutor Pepita Jane Petralba declined to give details on their involvement.
The respondents have 10 days from receipt of the order to submit a written answer to the allegations thrown at them.

Prosecutors Abarca and Ma. Luisa Ong were assigned on Vidal's case after several of them declined due to “workload” or “personal reasons.”

Should the respondents fail to submit their counter-affidavits on the deadline, the prosecutors in charge have to resolve the case based on the evidence submitted to their office.
CEBU DAILY NEWS tried but failed to contact Joel Ouano, the Archdiocese's legal counsel, on the case.
