Kung ni expire na diay ang lease of contract then by all means you have the right to get the deposit, just get a lawyer and make a demand letter stating that you want to get your deposit back otherwise you'll file damages. Pero mas nindot kung na-a mo copy sa contract for basis sa inyo case
actually, you can demand from the landlady. if i get the picture right, your contract already expired. you were about to renew the same but your landlady asked for an increase. because there was no renewal of contract, you have all the right to claim your deposit/s.
Thus, you can send a demand letter (stating exactly how long you will give her to return) address to her asking her for the return of the deposit. when she receive the same, have it sign by her with date. (the reckoning of the number of days is not the date of the letter but rather the date upon receipt.)
If she will not listen, this is already considered as other form of swindling. thus you can file an estafa case. you have all the right of the world. use them.
by the way, truly the proper authority to settle your case at the barangay is the lupon ng tagapamayapa. if there was no settlement then, ask for a certification of non settlement and file a case at the proper court.
yes ang contract unta to imong strongest hold against niya.. but i think maka demand man gihapon ka sa copy.. make sure she gives you the authentic one with both parties' signatures.. lessor and lessee.. you should also have all the receipts sa inyo monthly payments.. mas maayo gyud mo consult mo og lawyer.. naa man public attorney's office sa capitol para they can give you your best options.. otherwise mahawa nalang mo dha bec sa kasamok and hassle without getting your deposit back.. coz if mo expire na ang contract your supposed to get it back man after kuhaan if ever naa damages sa place.. or if ganahan mo inyo nalang i-consume.. but with your situation i highly doubt that's going to be the case...
You have the right to get a copy coz kamo gud both parties nag enter og agreement. pero Im sure e-hassle2x jud mo ana labi na boang2x ang landlady. But maybe you can start writing a letter to the lawyer, kay kong verbal lang bali-balihon ang storya ana nila. Expect lang sad daghan labad sa ulo labi na when dealing with a lawyer
