What do you mean without investigating? You know why the documents were not admitted as evidence? Because then-US Secretary of State Madeleine Albright, the one who verified the authenticity of the said documents, does not want to testify in court. Her written statement is not enough, she should testify under oath. That is really the reason why the documents were "rejected". Yes, as provided in our Public International Laws, foreign states (as represented by their government officials) are outside the jurisdiction of Philippine courts, but they may choose to voluntarily participate in hearings notwithstanding that limit on Philippine courts' jurisdiction. That being clear, if they are really that convinced of Webb's innocence, why not dive into the fray to protect or help him? They can't just say that the non-admission of their documents is "insulting". What do they expect, that the "dog" known as the Philippine Courts take every bone tossed their way by the American "masters"? If that were the case, then expect a lot more cases in the future to be decided based on whether or not the USA intervenes and issues certain documents.
Back then, DNA testing was ruled to be unreliable because our country did not have the equipment. DNA testing back then was very inconsistent, as proven in different cases.
Jessica Alfaro's words were enough to convict because she provided a first-hand account of what went on the night of the crime. It was further fortified by the testimonies of the other witnesses (the Webb househelp, Gerardo Biong's girlfriend, and the others). Their different testimonies complemented each other. You cannot say that all the witnesses were briefed to give fabricated accounts. You think Alfaro, the househelp, Biong's girlfriend, and etc actually conspired just to convict Webb and company?
People keep on pointing out Alfaro's past as a drug addict, but what about Webb? He was a drug addict as well (although naturally, he denies it). Ponder on that.
I don't totally disagree with this line. But before you point a finger at the courts, get your facts straight first and make sure you actually understand what you're saying and that you're not just jumping on the Philippine Justice System-bashing bandwagon for the hell of it.
And in whose favor do you think this slow-turn of the wheels of justice tilted? Pro-Webb and company ka as can be culled from your posts. Huna-hunaa, why would the widower Vizconde want to make this case drag on? As much as possible he wants the case over and done with. So if you're taking issue with the case being "old" because of the incompetence of the courts, then you have your friend Webb to blame for employing different dilatory tactics.
It's not an issue about the good 'ole USA manipulating the records. It's just that the evidence the Webbs and the other accused presented weren't enough to overturn the evidence and testimonies of the victims' side.
Vizconde was not the one who "cleaned up all the evidences in their house". It was Gerardo Biong, remember? Why would Vizconde clean up the evidence, he just lost his family for crying out loud! Why clean up the stuff that can help you pinpoint the culprits?
Now as to the "get jailed without proving" part, our Constitution under the Bill of Rights provides that the accused should not be held to answer for a criminal offense without due process of law. That part where you pointed out the lack of evidence needed to convict is correct, but it is not applicable in Webb's case. He was not denied due process, he was allowed to present all kinds of evidence, different witnesses, everything but the kitchen sink to attest to the innocence he claims. The semen sample is not the only angle that can prove the guilt of the accused. Abi na-wala ang semen sample wa nalang diay kwenta ang uban evidence? The burden of proving innocence falls on the accused, so if Webb and company really want to prove it, then they should pull all the stops. Bisag unsa na man lang ang ilang angle na gi-exploit.
Get your facts straight first bro.
And also, don't you guys find it strange that only the Webbs are continuing with this struggle? What about the other accused?
Do you really feel more pity for the accused whose guilt was established beyond reasonable doubt over the victims and the widower who lost his family to a brutal and grisly rape-slay? Just because Che-Che Lazaro re-visited the case and made a documentary which (obviously) favored the side of the Webbs? And why didn't she also interview and seek the sides of the families of the other accused? The power of media. Let's think for ourselves and not just believe and be swayed by whatever the media presents us.
