    Default HELP! Leave the company with bond issue.


    Hello,

    I'm posting for a friend cuz nag ka problema cya sa iyang previous company and the situation goes like this..dli lng nako nganlan ang company ha.

    Actually .net web developer ni cya, g.orient cya sa HR with the company blah blah then at the same time nag sign pd cya sa contract with a 2 year bond worth let say 100k. He was promise also for a new project development once mo start na cya ddto. But what happen when his 1st day kay g.orient cla nga for 6 months ang ilang work is to convert static HTML pages to CMS. mao nga nag rigor iyang huna2x and because of that wla na cya mo report the next day kay feeling niya giilad cya nganu daw wla cya gisultihan before cya ni sign sa contract kay if g.inform pa cya dli daw cla mo dayun. Mao nga ni AWOL cya the next day dn that day aslo the company called and advice him to report and pra sd magka talk cya sa company guidance, mao to nga iyang gisulti ang iyang side about the situation and dli na lng cya mopadayon og report. but still the company insisted nga pabayron cya sa bond for what he did. and just today he received a letter to inform him about the bond issue and dapat jd cya mobayad or else the company will take a legal action.

    ang akong mga pangutana:
    1. Tan.aw nnu kailangan bah mobayad sa bond ang akong amigo? nga 1 day rmn cya nka report ang beside the bond is intended for training but wla pmn cya ma train og anything.
    2. Naa bah ma preso kn dli mobayad sa bond?
    3. Asa mn ta mo dool ani about ani nga issue?

    your advice/help is pretty much appreciated.

    @Mods - g.try ni nako search but mura wla mn ko kita nga topic like this. Or kn naa man ngani pls let me know pra e.send nako ang kani nga link pra ma delete ni. or somebody nga nkahibaw nga naa nani nga thread again pls let me know. Thanks a lot.

    nakadawat ba ug kwarta imong amigo? basin diay nag-advance siya. ang angay jud buhaton sa imong amigo kay makigtalk sya sa management ug HR ingnon niya dili na mao ang nasabutan. ang nakapait kay kontrata man gud ug korte ray makadecide nga void or misleading ang contract.

    contract means meeting of the minds. wa juy kontrata nga mahimo kung wa nagmeet and ilang gipanghunahuna or gikasabutan.

    wla ra jd cya nkadawat og kwarta og ni advance bai. the only reason ra jd sa iyang pag leave ang kadtong information nga for 4 months d i to be exact mga mag convert cla from static content to cms using a tool. ako lagi cya sad g.advice nga talk ther HR or company guidance/counsel or kn dli madala jd try to go to DOLE and ask for advice/opinion.

    I think the company can do what ever they want to your friend. why?

    1st He/She Signed a Contract not knowing the content of it, even though awahe ang orientation sa company. (That is the common mistake nato mga pinoy, wlay basa2x diretso pirma kay kwarta na lage).

    2nd He/She is already committed to the company after signing the contract, the problem wla siya nananghid sa Company ni AWOL siya and that is a very UNPROFESSIONAL way in protesting and the company has the right to take actions.

    3rd Seek Legal Assistance from a Professional, Lawyers wont give advices in forum sites, it requires an amount to open their mouth.

    1st - gibasa jd daw niya ang contract. wla ra cya problem that's y ni sign ra cya. ang only problem or rather issue pra niya kay kadto nang pag 1st day niya nga same person ang nag orient nga mao sa daw to ilang actual work for 4 months. imagine 4 month mo mag ingato where in the 1st place gi promisan cla og project related sa ilang job description. to be exact naa na existing team daw pra mobuhat ato pero gipatabang lang sa daw cla but i guess 4 month is too long for that kind of work and he expected nga ang iyang trabaho is about .net development.

    2nd - i agree with you, i even said that to him.

    3rd - yup it's true. i just only ask some advice or maybe naa someone here nga same og situation and then he/she solved it.

    from what i know and from what i experienced, CONTRACTS are not binding- sort of- hehehe...bitaw bai, i have a good friend who is a lawyer but tua na ron siya sa US...i worked in a call center before, as well as most of my cuzins...and we all had sumthing in common, when we hate the job, we quit...with or without notices...and so far wala pa mi na priso tanan...hehhe, actually wala man issue and habol ang company sa imu friend the way i see it...wala man kaha kwarta nga na hatag and wala pud siya trabaho na na buhat, i think all of us has the right to have a period where-in we try to "feel" the job. mao bitaw naay trainings and screenings para mahatagan ta ug time na maka huna2x if nahan ba diod ta ani or dili....

    ako advice sa imu friend bai is HAKUNA MATATA...no worries, and look for other jobs...promise wala silay mabuhat sa imu friend na maka priso niya...change ur numbers and addresses too...hehehe
