    Today I signed Executive Order No. 1, establishing a commission to investigate allegations of anomalies during the last nine (9) years. The process of bringing a necessary closure to the allegations of official wrongdoing and impunity has begun.

    Alinsunod sa aking pinangakong gagawin sa loob ng unang “100 days” ng aking administrasyon, magsisimula na ang ating Truth Commission, na pinangungunahan ni dating Chief Justice Hilario Davide, Jr.

    Tungkulin nitong magsiyasat at hanapin ang katotohanan sa mga matitinding alegasyon ng katiwalian noong nakaraang siyam na taon na diumano kinasangkutan ng mga opisyal ng pamahalaan at ng kanilang mga kasabwat sa pribadong sektor.

    It lacks teeth and needs more than just this:

    SECTION 9. Refusal to Obey Subpoena, Take Oath or Give Testimony. – Any government official or personnel who, without lawful excuse, fails to appear upon subpoena issued by the Commission or who, appearing before the Commission refuses to take oath or affirmation, give testimony or produce documents for inspection, when required, shall be subject to administrative disciplinary action. Any private person who does the same may be dealt with in accordance with law.

    Words in bold are vague and most likely do not mean much as a deterrent. Plus there is the issue of its constitutionality being challenged at the SC. Good luck nalang didto.

    Had it been created by an act of Congress it would have had more powers at its disposal. Pero like most people, it would take longer and we want to know ASAP.

    An EO can only do so much but at least with the powers and immense influence of the Executive at its side, it is more than enough to persuade people to talk. I am not expecting a lot pero it is a good start.

    i am quite disappointed. perhaps i was expecting too much, but a Truth Commission, as was used previously by other countries such as South Africa were not just quasi-legal means of resolving past issues but also a means of renewal as the issues addressed by the commission touch the most basic nerve among the entire country itself, which essentially were the human rights violations, as a result of the apartheid regime.

    surprisingly, instead of taking in and investigating the scandals of the previous administration (or administrations) in its entirety, it seems that it is now selecting what it wants to investigate, focusing on corruption cases and election fraud, but leaving out the astounding number of human rights violations from a state-sponsored terror campaign, even the participation of the Arroyo administration in propping up the Ampatuans in Maguindanao.

    not only does our version of the Truth Commission leave out an essential touch point in its entire agenda, it was not crafted in such a way that it would have powers beyond a mere recommendatory body. in his SONA, the president promised "prosecutory powers" for this commission, which lead to naught since he cannot give a power that he does not have, reducing the commission to the usual fact-finding commission that a president can order anytime.

    it now appears that the administration is in no way capable of instituting the breadth and power of a truth commission with much caliber as that of South Africa's and other countries. our version of a truth commission does not even come close. and this is terribly disappointing as this is Noynoy's chance of proving himself early on.
