I want to make things straight. I don't like Joel Quino nor Ritchie Wagas! But it is obvious, Ritchie wagas wasted his opportunity to turn things around when he took over the mayorship. Instead of proving to us that he isn't like his brother, what happen is another allegation of unliquidated expenses incurred by his office that would reach around 7M.

And one thing bro, Ritchie claimed he was cheated on the election. We all know how funny those whistle blowers (Alias Koala Bear, etc.) are when they try to expose how to cheat during elections. We all know that "butas ng karayom" imo agian to cheat on that election.

The factual milieu in the instant case is akin to the case involved in COMELEC
• Resolution No. 898910; hence, we deem it necessary to apply said Resolution hereto, and for this purpose we quote the preliminary statements therein, as well as the diapositive portion thereof, as follows:
"WHEREAS, in a letter dated 15 Mat' 2010, the Municipal Board of Canvassers of Pinalpitk, Kaling,a reported that on 11 May 2010, three (3)clustered precincts namely,. Clustered Precincts 8, Clustered Precincts 12, and Clustered Precincts 1-I together with all the other clustered
precincts in the said municipality transmitted results to the Consolidation and Canvassing Center of Pinukpuk, Kalinga;
"WHEREAS, when the Consolidation and Canvassing Center of Pinukpuk, Kalinga received a one hundred percent (100%) transmission from all the clustered precincts, the Municipal Board of Canvassers (MBOC) then also transmitted the result to the Provincial Board of Canvassers and to the National Board of Canvassers;
"WHEREAS, on 12 May 2010 however, watchers of different candidates infarmed the above MBOC that the three (3) clustered precincts out of the thirty six (36) clustered precincts have transmitted the results of the FINAL TESTING AND SEALING of the PCOS machines instead of the election returns of the May 10, 2010 elections, as reflected in the Election Returns printed om such PCOS machines. Upon verification, it was Jo. und out that there indeed were discrepancies in the transmitted results of the three (3) clustered precincts.
"WHEREAS, the error was discovered after the MBOC' had already proclaimed the winning candidates based on the electronically transmitted results
"NOW, THEREFORE, the Commission RESOLVED as it hereby RESOLVES:
"I. To initiate annulment of proclamation proceedings in so far as the aforesaid proclaimed candidates;
"2.That after due notice and hearing, annul all proclamation and direct the MBOC, CBOC or PBOC concerned to proclaim the rightful winners, in the age' cled positions; and,

It is no proclamation at all and proclaimed candidate's assumption of office cannot deprive the COMELEC of the power to annul the proclamation."
Despite all the foregoing, however, we are not at this stages ready to grant the petitioner Wagas' prayer to declare the proclamation of the winning candidates in the
Municipality of Compostela, Cebu, from the mayor down to the vice--mayor and the eight ( municipal councilors as null and void. As between the petitioner and respondent, the two (2) requisite steps (No. 1 and 2) stated in the dispositive portion of the above-quoted COMELEC Resolution No. 8989, had already been complied with: (1) annulment of proclamation proceedings had already been conducted as between herein petitioner Wagas and respondent Quino; and (2) after due notice, hearing had already been conducted with the parties submitting their respective memoranda. However, because the other proclaimed candidates for the positions of vice mayor and eight councilors. who are all indispensible parties and entitled to due process of law, have not been impleaded in the instant Petition, the Commission has not acquired jurisdiction over them.
WHEREFORE, premises considered, the Commission ORDERS to, as it does hereby, GRANT the "Extremely Urgent Motion to Suspend the Effect of Proclamation" filed by petitioner Ritche Wagas, hereby immediately suspending the effect of the proclamation of the candidates for mayor, vice-mayor and eight councilors of Compostela, Cebu. In the meantime, said petitioner is hereby give three (3) days from receipt of this Order to .amend the instant Petition in order to implead said indispensable parties.

Amidst the damages that the Wagas supporters had inflicted against our family, especially my Mom, and Mayor Ritchie's insensitivity to his supporters' actions towards us, my family and I still hope that Compostela would soon get through such turmoil. We have friends and relatives there and we are also disheartened by what the municipality has been going through.

Be strong, Compostelahanons. You are not given such trials if He didn't know you'd be able to rise up against them.
