Macalintal said issuing an EO revoking Corona's appointment would violate Sec 2, Article 11 that states "The President, the Vice-President, the Members of the Supreme Court, the Members of the Constitutional Commissions, and the Ombudsman may be removed from office on impeachment for, and conviction of, culpable violation of the Constitution, treason, bribery, graft and corruption, other high crimes, or betrayal of public trust..."
    -------------------------------------------
You know, these people are so ghey and show lack in ability of translating the constitution without appearing incompetent. No where that it state within Article 12 Sec 2, that pertain in coherent to Macalintal statement. Can I use that word Bobobo? Yet the two Article below are the following reason why this has become an issue.
    ARTICLE XI
    ACCOUNTABILITY OF PUBLIC OFFICERS
Section 11. The Ombudsman and his Deputies shall serve for a term of seven years without reappointment. They shall not be qualified to run for any office in the election immediately succeeding their cessation from office.

Didn't Aroyo just won the election in her home town for a set in congress as a sitting President? Hey JUDGE wake up!
    -------------------------------

    ARTICLE VII
    EXECUTIVE DEPARTMENT
Section 15. Two months immediately before the next presidential elections and up to the end of his term, a President or Acting President shall not make appointments, except temporary appointments to executive positions when continued vacancies therein will prejudice public service or endanger public safety.

The appointment of Renato Corona is illegal your honor. These two article are pretty straight forward, there should be no misconception in this. But for some reason and intent, the Judiciary branch have manage to violate Sec 2, Article 11 themselves. I think all of you that voted and broken your oath need to be impeach and the people of this country can be better served.

What embarrassment? When some people say that the swearing in by Noynoy before his barangay captain will embarrass the country, do they lay claim to embarrassment for having LOWLY people getting the publicity? We use Juan to portray the true Filipino face and circumstance and we flash his face throughout the world ( look at how many OFWs we have across the globe) and take pride in him, so there's definitely nothing wrong with empowering the barangay captain and giving a few minutes of fame to this lowly man or woman.

Corona's appointment to SC chief justice is certainly TAINTED. It doesn't take a genius to figure out his being beholden to the outgoing administration. He will not and cannot be perceived as independent because he has always demonstrated partisanship. This is the kind of partisanship (or obvious corrupt practice) that typifies the Arroyo administration.

The people have repudiated the Arroyo administration, resoundingly I must say, giving credence and truth to reports on corruption. A lowly man may not understand the dynamics of politics but he/she can undoubtedly see when politics is used to further personal ends. He/She knows too that the ballot is his/her most potent arm in saying "NO MORE".

The people who have repudiated the exiting administration are those who the barangay captain truly represents - not Corona. It is time to deviate from tradition if only to send a message that the Republic of the Philippines is really for the likes of the barangay captain, Juan. If, after the oath taking ceremony Noynoy decides to have a grand victory celebration with a sumptuous dinner for the Juans and his barangay captain as special guest, I'm sure he will not spend as much if he treats them to a dinner in America.

It is really when we think of our political leaders (and other leaders in governance) as SPECIAL that they too will come home each night (if they do come home)thinking they are indeed special, forgetting that they are PUBLIC SERVANTS. Again, it is about time to change tradition if what we do (or at least our political leaders)is to always bring back to the people the spotlight, the dinners, the taxes, the Malacanang (Congress, SC)and what it represents, etc.
+ ko ani. Though PGMA was given the right to appoint the next SC Chief Justice, I challenge her to appoint a more credible Magistrate. Apparently, she won't because the incoming Chief Justice would be the final bastion to decide on the cases that will be filed against her and her family.

In other words, her last appointment would be her life line for the next year or two while she maneuvers to become the speaker of the house and amend the constitution.

    Amen!

    This is the Constitution.
The law that should have been followed.

Unfortunately, Gloria has proven she can bend the law and people are allowing it to happen.
Please please please, to those who still gripe for their candidate's loss, don't speak as if you know the constitution.

Even I don't, but I never throw any accusations which are baseless.

    RESPECT THE RULE OF LAW

At the same time, Puno worried that Aquino’s refusal to recognize Corona could lead to a constitutional crisis and advised the LP bet to respect the rule of law should he be proclaimed president.
Puno noted that the Court has already come up with its ruling which declared that the constitutional ban on midnight appointments does not cover vacancies in the SC, thus, upholding the authority of President Arroyo to appoint his successor.

“The rule of law is the glue that unites our society,” Puno stressed. “Without the rule of law, our society will disintegrate. All of us should observe this rule of law, there’s nobody who can excuse himself and say that he is not covered by the rule of law. The higher you are in the government the more you should respect the rule of law.”

He said all the three branches of government – the executive, legislative and judiciary – according to Puno, should unite in promoting the good of the people.

    -------------

Plus di lagi ka appoint pud si noynoy ug iyang kaugalingon CJ. kay unconstitutional.

Arroyo appointed a chief justice because if the sitting president hesitates to appoint a Chief Justice, Noynoy cannot appoint a Chief Justice if they will follow the logic that they have to pass through the JBC (Judicial and Bar Council)," he said. There will be no JBC when Aquino assumes the presidency on June 30 because of the absence of the Chief Justice, Enrile said.

dont speak as if mas bright pa mo sa law compared to Puno ug Enrile lol.
