Under article VII of the 1987 constitution the president-elect shall, upon assumption of office, take his solemn oath of office..xxx. The said provision neither specifies nor obliges the president-elect to take his oath before the supreme court chief justice. Therefore any person authorized by law (and that includes a barangay captain) is free to sworn noynoy in office.
It should likewise be noted that former president Corazon Aquino herself upon her formal assumption in office did not take her oath before the then chief justice Ramon Aquino but instead she chose to be sworn before associate justice Claudio Tehankee, which is obviously not the chief justice.
