On the CJ Davide impeachment complaint issue
• The best answer to that is that's why YOU are FILING a CASE, to give then Former CJ Davide the opportunity to CLEAN his name amidst allegations of corruption. Institutionally, that is the best way you can allow a person of institutional importance, the opportunity to be heard by a fair, just tribunal. Filing a case does not mean he is guilty by criminal liability, it only means that the allegations affect his performance of duty, because of the required credibility of the position he holds, affected by this incident. Plus, you SPONSOR a case BASED on the premise that there is sufficiency in form and substance for the case to be tried, but does not presume the guilt of CJ Davide in that matter, and that will have to be tried by a separate court, and not the impeachment court. The knock on those who are accused is that once they are accused of such case in the proper forum, they always answer "it is politically motivated", instead of answering the issue head on.

The issue was about the Judicial development fund.
Let's remember that it is mandated in LAW that it is the Chief Justice who is the administrator of the JDF
Now this fund is intended to provide members and personnel of the judiciary with COLA (Cost of Living allowance). This allowances actually constitute the majority of judiciary employees take home pay. Yet, as of the end of calendar year 2002, more than P500 Million required by law to be paid as additional cost of living allowance to the members and personnel of the Judiciary had not been paid. The Judiciary Development Fund was used to purchase luxury cars, worth millions of pesos, for members and officials of the Supreme Court; the Fund was used to purchase P5,568,630.00 worth of curtains, and P8,125,445.00 worth of “loose furniture,” for the Supreme Court’s Session Hall. More than P34 Million out of the Judiciary DevelopmentFund was spent for the construction of vacation homes in Baguio City for the use of Supreme Court Justices, their families and chosen friends, at a time when the average capital outlay for infrastructure of state colleges and universities under the General Appropriations Act is only P1 Million. The law provides that at least eighty percent (80%) of the Fund shall be used for cost of living allowances, and not more than twenty percent (20%) of the said Fund shall be used for office equipment and facilities of the Courts located where the legal fees are collected. This law has been violated, and constitutes sufficiency in form and substance, based on records, that his acts (may) have been a neglect of constitutional duty, giving probable cause to removal based on the grounds of CULPABLE VIOLATION OF THE CONSTITUTION.
