While critics slam her proclamation of a state of national emergency, President Gloria
Macapagal-Arroyo is planning to issue yet another order to rout her perceived political enemies,
Senator Joker Arroyo said yesterday.
"In what form? We don't know but in this country, there is never a secret," Arroyo said. "What
we should worry about is the third one. I don't know if it is creeping martial law but there's
something coming."
The warning came amid what appeared to be a setback for Arroyo's critics in the Supreme Court.
Chief Justice Artemio Panganiban yesterday said that while the high tribunal was giving high
priority to four petitions questioning the constitutionality of Proclamation No. 1017, it
would not be goaded into issuing a temporary restraining order (TRO).
In an en banc meeting, the court set for Tuesday next week a hearing on the petitions and asked
the government to submit by Monday its justification for the President's action on
Friday last week. The court opted not to grant the request for the issuance of a TRO until it
had heard all arguments, Panganiban said.
Senator Arroyo said his sources told him that the President had another order "under way" after she
succeeded in "emasculating" the Senate through Executive Order No. 464 and frightened media
owners with Proclamation No. 1017.
Worse, Arroyo said these orders "were planned in advance" for the "long term" but were being
implemented in a calibrated manner that he described as "presidential terrorism."
The senator said "464 and 1017 are not spur of the moment presidential issuances. Both were
planned in advance. Our own info is there's a third one coming against an enemy we don't know
yet because, you know, it's the President who chooses her enemies."
Arroyo said that Malacañang was emboldened to issue this supposed third order because there had
been no strong public backlash against Proclamation No. 1017 and Executive Order No.
464, which bars officials from appearing in congressional hearings without the President's approval.
Media owners frightened
He also noted that media owners had "become frightened" by Malacañang's threat to take over their
businesses.
"The thing is that the Palace will not stop. Malacañang thinks that they are winning. The
Senate has been paralyzed. The media, for all the braggadocio of the owners, are frightened," Arroyo
said.
Arroyo said that the orders were planned after EO 464 was issued in September last year.
"How would we ever know that 1017 (was) directed against the media? Nobody knew it. But it's not
really (about) warrantless arrests, it's media. The one that has been affected so much (by 1017) is the
media," he said.
"Nobody predicted that. Nobody knew it but now it's very clear. They're not after (Anakpawis
party-list Representative Crispin) Beltran or (Bayan Muna Rep.) Satur Ocampo. They're after media,"
he added.
Arroyo said he did not expect Malacañang to lift the state of national emergency any time soon.
Constitution is no more
"They will not lift it. They're winning from their point of view. You should quit when you're
ahead but they're not quitting. The Constitution is no more as far as Gloria is concerned," he said.
"Gloria, she does not care about how many enemies she has. She doesn't care about winning friends.
She cares only about acquiring enemies. Here in the Senate, Gloria has no friends," he said.
Arroyo also said that media owners should stand their ground against pressure from the Palace.
Chief Justice Panganiban told reporters that the magistrates had agreed that the high court must
resolve the issue immediately because it involved basic issues, including the freedom of speech and
freedom of the press.
"No TRO because due process requires that in significant cases, you must hear the other side.
A TRO is issued in order to maintain status quo. If the status quo has changed, I would have to
convene the court between now and Tuesday," Panganiban said.
"First, we know that there is some urgency so the court required the respondents to submit a
comment within a non-extendible period of five days," Panganiban said.
Highest priority
"Freedom of speech and expression are quite very important, the highest priority in the Bill of
Rights, so any alleged violation would require attention of the court. We are giving it the highest priority," he said.
As of Monday, four petitions had been received in the Supreme Court, including a challenge by the
Daily Tribune, which was raided by police on Saturday.
The fourth case was filed by former Senator Loren Legarda yesterday.
Legarda said directives issued by Ms Arroyo had "invaded almost all freedoms and rights
guaranteed under the 1987 Constitution in the guise of suppressing acts of terrorism and lawless
violence in the country."
These directives, she stressed, "unnecessarily and without any legal purpose drag into its ambit
the suppression of the constitutionally guaranteed freedoms and civil liberties, among
them the freedom of expression and its cognate rights."
Panganiban said the court would consolidate all these cases along with those yet to be filed into
one suit.
Guidelines for broadcast
Also yesterday, the National Telecommunications Commission (NTC) said it would allow the main
umbrella organization for the broadcast media to draw up its own guidelines on news coverage during
the prevailing emergency.
NTC chief Ronald Solis said in an interview that guidelines formulated by the Kapisanan ng mga
Brodkaster ng Pilipinas (KBP) would be adopted by state regulators and would be applied uniformly
to all broadcast media facilities.
"The NTC will enforce these guidelines even on non-KBP members," Solis said in an interview. "If
they don't accede to it, we'll still enforce it."
Government is prohibiting media entities from airing stories that incite sedition, revealing
troop movements during combat operations, and airing propaganda.
Solis said the KBP would define the parameters.
He said that while the NTC had no way of directly sanctioning foreign broadcast outfits that might
violate government regulations, his office was coordinating with the organization of cable
television operators to see how the guidelines could be enforced.
"But if it's impossible to regulate, we won't do that," he said.
Solis pointed out that the NTC had no power to shut down broadcast outfits under Proclamation
No. 1017, but added that regulators already had such existing powers under their charter.
The NTC chief also stressed that the government would not impose more stringent control
mechanisms to muzzle the press, but would instead only implement existing guidelines, including an
order promulgated in 1989 used to shut down radio stations that were found to have aired details on
troop movements during a coup attempt against the government. With reports from Christine O.
