The issues against Estrada

1. Secret bank accounts

To hide his alleged illegally acquired wealth, Estrada was said to have maintained secret bank accounts, including one in the Equitable PCI Bank where he had over P3.2 billion under the name Jose Velarde. This was ordered frozen in August 2002 by the Sandiganbayan. Five other banks subsequently turned over to the Ombudsman statements of Estrada's accounts, as well as of his two mistresses -- Guia Gomez and Laarni Enriquez.

2. Excise tax scam

In 1998, Estrada allegedly pocketed P130 million from the excise tax share of Ilocos Sur province allocated under Republic Act 7171 (An Act to Promote the Development of Farmers in the Virginia Tobacco-Producing Provinces). The amount was allegedly divided among Estrada (P70 million), his wife Sen. Luisa Ejercito (P20 million), his son Jinggoy (P15 million) and his friend Charlie Ang (P25 million).

3. Illegal gambling payoffs

From November 1998 to August 2000, Estrada was said to and received from Ilocos Sur Gov. Luis Singson P545 million derived from the proceeds of "jueteng" illegal lottery operations in Ilocos Sur and other provinces.

4. Intervention in the stock market

Estrada was accused of pressuring then Securities and Exchange Commission chair Perfecto Yasay Jr. to clear the president's friend, Dante Tan, of any wrongdoing in the stock manipulation case against Tan whose firm BW Resources Corp. had a spectacular 5,000 percent increase in its share price from P2 to P107 a share in a span of eight months ending in October 1999.

News: Palace happy Estrada can defend self today

MALACAÑANG on Tuesday expressed gladness that former President Joseph Estrada, after five years of being on trial, will at last testify in his defense at the Sandiganbayan today.

Presidential Chief of Staff Michael Defensor—who had taken steps in vain to have Estrada given temporary liberty on the recognizance of Church leaders—said the only good thing about Estrada’s trial is that it has come near its end.

“This will be the last chapter of his plunder case. And even if we don’t know what he is going to say … of course he will defend himself, in general it [Estrada’s appearance in court] will be good for all,� Defensor said.

Earlier this year Estrada had expressed dismay at the government for letting his case sleep at the Sandiganbayan.

Three justices will hear the case: Presiding Justice Teresita Leonardo-de Castro, Associate Justices Francisco Villaruz and Diosdado Peralta.

According to Sandiganbayan Sheriff Eduardo Urieta, the PNP National Capital Region chief, Director Vidal Querol, will deploy around 1,000 police officers to secure the court.

No media coverage

Urieta said that no live media coverage will be allowed—as ordered by the Supreme Court—but reporters may go inside the courtroom to take down notes.

A video recording of the trial will be made by PTV Channel 4. It will be placed in the archive but may be shown to the public only after the judgment on the case is promulgated.

No ralliers will be allowed within a 100-meter radius of the court.
Estrada loyalists have announced that they will go to Mass at Saint Peter’s Parish Church and after Mass proceed to the Sandiganbayan.
Estrada will come from his detention cell in the Tanay rest house.

The trial will start at 8:30 in the morning and he will take the stand to speak on his defense till 12 noon. During the lunch break Estrada will stay on the sixth floor of the Sandiganbayan building. The trial resumes at 2 p.m., when he is expected to testify again.

Confident

Estrada, through his lawyers, has said he is confident of getting justice from the Sandiganbayan justices.

The Quezon City Police District will deploy around 600 policemen to regulate the rally that will start at Saint Peter’s Church.

Supt. Nicasio Radovan Jr., Quezon City police district director chief, said 300 policemen under his department would be initially deployed near the Sandiganbayan and the Saint Peter’s Church on Commonwealth Avenue.

Radovan will reserve 300 other policemen and about 400 other reserves will be supplied by the National Capital Regional Police Office under Querol.
Radovan expects Estrada supporters in the rally to swell to 2,000.

“We will exercise maximum tolerance but we will make sure that they follow the provisions of the rally permit,� he said in an interview.

I've read that Chavit's testimony was destroyed... and there were 2 bank officials who testified that the accounts belong to a different person. And the contents to that controversial envelope were not significant.

In addition, any person who participated with the said public officer in the commission of plunder shall likewise be punished.

I'm glad he is man enough to defend himself. Well for Plunder cases, which by the way is punishable by Death..Just enough verdict for this man.
