According to the SC Circular, the writ of Amparo is a remedy available to any person whose right to life, liberty and security is violated or threatened with violation by an unlawful act or omission of a public official or employee, or of a private individual or entity. In as much Lozada sought help to government officials at that time, it does not seem that there was kidnapping or a writ of Amparo should be properly issued. More so, he is more than free to roam around. It would be too much to say that his right to life, liberty and security is at stake right now.
