WALA BA NI'Y LEGAL CONSULTANTS ANG ABS-CBN?!!!!!
I saw today’s (August 12, 200

episode of the teleserye, “Iisa pa Lamang” and here is what I have to say.
The Fact that such video (disinheriting Catherine) exists (even if assuming that it is not fake) is of no moment. Article 916 of the New Civil Code provides: “Disinheritance can only be effected through a will wherein the legal cause therefor shall be specified,” while Article 804 of the same, provides that, “Every will MUST BE IN WRITING and executed in a language or dialect known to the testator.”
In other words, in order that the disinheritance be valid, such must be in writing. In the instant case, the disinheritance was merely contained in a video clip (again even assuming that it is not fake), therefore it did not comply with the legal requirements provided for under the New Civil Code, and as such, is of no effect.
ALSO, assuming, for the sake of argument, that the disinheritance is valid, still Catherine cannot be disinherited of his conjugal share. Pursuant to the Family Code, from the moment Martin and Catherine got married, Catherine already owned half (with a few personal properties exempted thereform) of Martin’s properties. This is so since, the parties did not execute a pre-nuptial agreement, in fact in one of the episodes, Martin even confirmed this (that they already owned the properties 50-50). If indeed, Catherine was disinherited, such disinheritance would only involve the conjugal share of Martin. Meaning, Catherine still owned half of the subject properties.
What makes this teleserye even more disappointing, is the fact that Catherine’s friend/lover, Rafael Torralba (Gabby Concepcion) was supposed to be a lawyer. However, he was not able to give Catherine the proper advise. We’ll what do you expect?! Even Rafael (who was supposed to be a lawyer) does not know the law. In the same episode, Rafael threatened to file a case of “Serious Physical Injuries” against those who assaulted Catherine. Being a Lawyer, does he not know the legal requisites in order for a person to be held liable for Serious Physical Injuries?! Di na ko ganahan mag elaborate, kapoy na!
With these blunders (and many more), I could only think of 3 scenarios, and these are the following:
(1) ABS-CBN has no legal consultants;
(2) ABS-CBN has legal consultants but are !n(0mp*+*n+; or
(3) ABS-CBN thinks that its viewers are stupid
I have noticed a number of flaws with Philippine’ Teleseryes but it was only now that I got fed up.
