Actually, this isn't really a problem withe OpenOffice itself, but with Microsoft. The specifications for the .doc or .xls formats are not open, so the OpenOffice team had to mostly reverse-engineer and study the MS formats to ensure compatibility. The default formats of OO.org are actually not that bad (ODT, ODS, etc), since these are based on the OpenDocument format.
