HELP: My car got scratched inside the parking space of a restaurant. Can I have them liable for the damage?

Mga boss I have a question,

I was at Tonyo's in IT Park a few days back. Karon pag uli nako naay mga garas akong sakyanan (not the typical garas nga gikan sa driving kay gi drawing drawing gyud ang type sa garas). The following day I went back to Tonyo's to tell them about what happened to my car then akoa sila gihatagan sa quotation sa repair which I got from Toyota. Ang manager said nga dili daw sila maka cover sa damages kay no proof daw nga sa ilaha na damage ang sakyanan. So here's really what happened:

1. Parked my car infront sa Tonyo's then after I went straight home.
2. Impossible nga diri sa akong house na garas kay my compound has a CCTV camera and nothing happened on my end.
3. According to the management, wala daw nakita ang guard nila na mga bata. But knowing these guards di man gani na mag bantay sa mga sakyanan ga parking sa ilang tugkaran.
4. The bar doesnt have a CCTV camera, in which, they can always deny nga wala nahitabo sa ilahang tugkaran.
5. Before going to Tonyo's I was in IT Park for a meeting and so far wala pa'y garas akong car prior to arriving at Tonyo's.

What frustrates me is that by law obligated man ang establishment mo bayad because that is a liability on their customers according to my lawyer. In this situation, gisapot ko nag hunahuna nga ang restaurant/bar can simply DENY what happened. Wala man gani nangatubang ang tag-iya. So for short, mura ra ug walay pakialam ang mga hinampak.

claim nalang og own damage sa imo insurance... it will cost you less money and effort rather than chase the resto that they are liable... it will take you ages to prove it not unless naa kay video gyud to prove it...

maski kanang mga paid parking, naa na silay mga disclaimer nga wala silay liability kung unsay mahitabo sa imo sakyanan...

I think you will be having a hard time proving tonyo's liability for what happened to your car. If you are really persistent to make the owner liable, there are legal remedies available BUT it will take you ages and will certainly cost you more money than the amount you want to claim. So to cut the hassle and to free your mind from frustrations, file for claim from your car insurance if it is covered under your policy but if it is not covered you have no choice but to shoulder the cost.

Dili liable ang tonyo's sa damage ts. E claim nalang na sa insurance. On damage if naa. Then participation nalang imo bayran.

If naa ka OD Insurance TS then pay for participation fee then the rest bahala na imo insurance ana, waste of time and effort lang ka if wala ka evidence or video to show na ang establishment gyud ang liable.

Parking is for customer convenience. Kasagaran jod, dili sila liable. Ang nag drawing mai liable. Somewhat, park at your own risk. Kami, we no longer mind the minor scratches sa amo car. Naa jod na sooner or later. Mahal kaayo cge wash over. It will eventually go beyond the cost of your car. Save it for a new car in a few years nalang.

how deep ang scratch TS? if ma wala ra siya pag butang ug tupig ang top coat ra nah nga garas.. you can use those scratch remover

sadly TS maglisud jud ka ana. kay bisan gani ang mga dagkong malls like SM ug Ayala naa juy disclaimer nga "carpark management is not liable for any damage/loss..." kana pa sa Tonyo's nga free parking ra pa jud. gamita nalang jud imong OD insurance TS.
