Process: Transfer of Title through Deed of Sale (Non-Corporation)
1. Deed of Sale
- CEDULA
- Valid IDs for both Seller and Buyer
- secure official receipt from the lawyer
2. Secure Checklist sa Registry of Deeds and another Checklist sa BIR
3. City Assessor's Office
- submit a copy of the notarized deed of sale
- pa sched for inspection of no improvement
- secure certified true copy of the latest Tax Declaration issued by the Local Assessor's Office for land and improvements applicable to the taxable transaction
4. BIR
- pa compute for taxes. It will be based on whichever is higher: Total Contract Price sa Deed of Sale, Market Value or Zonal Value
a. Documentary Stamp
- deadline of payment is every 5th of the month
b. Capital Gains Tax
- deadline is 30 days from the notarial date of deed of sale
Requirements:
- TIN of Seller and Buyer
- Notarized Deed of Absolute Sale/ Document of Transfer
- Certified True Copy of the latest Tax Declaration
- Certification from the Assessor's Office that the tax dec presented is still existing and no new assessment or revision has been made up to present
- Original Certified True Copy of Transfer Certificates of Title (TCT), Condominium Certificate of title (CTC), Original Certificate of Title (OCT)
- Certificate of No Improvement issued by the Assessor's Office, if applicable
- Valid IDs (bring original for presentation and 2 photocopies) of the processor (need SPA if not the Seller or Buyer)
- Acknowledgment Receipt
- History of Ownership of the Property/ies sold or TRACER
- Official Receipt issued by the Notary Public/Lawyer notarizing the documents presented
- Official Receipt/ Deposit Slip for this purpose and duly validated "return" as proof of payment
- P100.00 certification fee and P15.00 documentary stamps issued by the BIR cashier
- Location Pla/Vicinity Map if zonal value cannot be readily determined from the documents submitted
Note:
a. All documents must be in 3 copies (1 original and 2 photocopies)
b. Both Seller and Buyer have TIN duly checked by the Registration Section, BIR.
c. Capital Gains Tax Return (1706) and Documentary Stamp Tax Return (2000 OT) must be filled up completely.
d. All government Official Receipts issued in relation to the certified true copies requested must be attached in 3 copies. (1 orig and 2 photocopies).
5. Registry of Deeds

For Cancellation of Annotation:

- 1 month processing for Release of new TCT without encumbrance
