    Why is Radaza still Mayor? It ALL reflects to the Majority of the kind of voters LapuLapu has.

    Look at Mandaue, they smartened up and booted Ouano out of office. Not unless people in Mactan will do such feat, they will still be labeled as one of the most corrupt LGU in the country or are they still praying that the Mayor will have a sudden change of conscience?

    Formal probe set v. Cebu legislator, 8 others

    CEBU CITY -- The Office of the Ombudsman-Visayas has resolved to file three counts of malversation of public funds charges against Rep. Clavel Asas-Martinez and eight others for the P26.5-million Girl Scouts of the Philippines (GSP) controversy.

    Deputy Ombudsman Primo Miro approved Director Virginia Santiago’s final evaluation report (FER) that also recommended that the committee on ethics of the House of Representatives be informed of the issue, “for whatever action they may take on the matter.”

    The GSP controversy centered on how Martinez (Cebu, 4th district) allegedly disbursed a total of P26.5 million from her Priority Development Assistance Fund (PDAF) into her personal bank account by using the GSP as conduit in 2002 and 2003.

    Sun.Star Cebu tried repeatedly but failed to reach Martinez for comment Friday.

    The charges, if not refuted during the formal investigation, will become a formal case before the Sandiganbayan.

    Calls made and messages left in Martinez’s mobile phone, as well as that of her husband, were unanswered.

    However, Martinez, who sided with the opposition during the recent impeachment proceedings against President Arroyo, denied the allegations in previous interviews.

    While she confirmed that she released P11.5 million from her PDAF to the Municipality of Bogo via the GSP, the money was transferred to her bank and then to the town’s treasury.
    This was to expedite procedure. Martinez had said that there was no loss of funds.

    But the Office of the Ombudsman-Visayas did not see it that way.

    “The evidence clearly established that Martinez performed acts through evident bad faith and manifest partiality (that) resulted in or caused undue injury to the government in the total amount of P26.5 million,” Santiago’s FER read.

    “She is liable for the crime of malversation of public funds, as she misappropriated for her own personal use and benefit the total amount,” it further said.

    Santiago’s FER, based on office procedure, will take the form of a criminal and administrative complaint, which will then be subjected to preliminary investigation and adjudication by the anti-graft office’s investigation branch.

    If probable cause is established during preliminary investigation, where Martinez will be asked to answer the allegations, a criminal case will be filed against her before the Sandiganbayan, which has jurisdiction over high-ranking officials like members of the House of Representatives.

    In Santiago’s FER, Martinez is charged together with her son, Celestino “Tining” Martinez III, and Bogo municipal officials Rhett Minguez and Cresencio Verdida. Tining is the incumbent mayor of Bogo town while Minguez and Verdida are the municipal treasurer and accountant, respectively.

    Paz Radaza, wife of Lapu-Lapu City Mayor Arturo Radaza and Girl Scouts of the Philippines Cebu Council president, is impleaded in the first two counts as a conspirator, together with fellow GSP official Alejandrita Meca.

    Two other GSP officials, Rhodariza Kilantang and Julieta Quiño, are impleaded in all three charges while Martinez’s daughter, Ma. Cielo, is included in one.

    Radaza had previously led the GSP council in an investigation into the matter and, in April last year, “closed” the probe that she described as “internal” in nature.


    Minguez and Verdida, for their part, will also be subjected to an administrative investigation for dishonesty and misconduct. These charges have a penalty of dismissal from service.

    Mayor Martinez, however, will not be included in the administrative proceeding pursuant to the Aguinaldo doctrine, which absolves all reelected public officials from any administrative liability over offenses committed in the previous term.

    The anti-graft office launched its fact-finding inquiry into the incident after it received last April 26, 2004 documents from a “concerned and troubled official of GSP-Cebu Council narrating how Martinez, on three occasions between June 2002 and October 2003, took out a total of P26.5 million from her PDAF and deposited it in her personal account.

    According to the unnamed complainant, the transfer was made convenient by Martinez’s incumbency as head of the GSP council at that time and the assistance of her daughter, Ma. Cielo, who was then the council’s treasurer.

    The charges, according to Santiago’s FER, were corroborated by a 12-page investigation report prepared by an ad hoc fact-finding committee formed by the GSP that the anti-graft office obtained in May 17, 2004.

    Records subsequently obtained from the Department of Budget and Management (DBM) on July 1, 2004 also showed releases of several amounts representing the PDAF that were intended for the Municipality of Bogo.

    The anti-graft office also got the assistance of the Commission on Audit, which conducted its own inquiry.

    According to Santiago, the first two releases, worth P7.5 million each, were done on June 13 and Sept. 18, 2002; the third, worth P11.5, was made on Sept. 22, 2003.

    The money, based on documentation, was for “development projects for the Municipality of Bogo,” including financing for the anti-drug campaign of the GSP.

    Based on Santiago’s report, Meca appears as having requested Mayor Martinez for the release of the amount to the GSP.

    The mayor, allegedly with the participation of the impleaded municipal officials, released the money through three checks. Two checks were deposited in the Land Bank of the Philippines Banilad branch, while the other one was in the Bank of the Philippine Islands Capitol branch.

    However, documents showed that the checks, with the alleged help of the GSP officials, were withdrawn and returned to Congresswoman Martinez, who deposited the amount in her name and released “a very meager amount of P600,000 to the GSP, “no longer for the anti-drug campaign programs but as donation.”

    “The amounts were not even taken from the P26.5-million PDAF of Congresswoman Martinez. The P500,000 came from her personal account with the Allied Bank, as shown in the Allied Bank check dated June 14, 2002,” Santiago’s report said.

    Probe barangay ‘numerators’

    Lapu-Lapu City, Philippines - The opposition barangay (village) captain of Basak, Lapu-Lapu City is urging the Office of the Ombudsman to look into the alleged ghost employees deployed in his village by Mayor Arturo Radaza about three years ago.

    Isabelito Darnayla claimed that 16 men whom they called “numerators” would only go to the barangay every 15th and 30th of the month to sign their payroll and get their salaries.

    These employees, he added, were assigned in Barangay Basak by Radaza between 2004 and 2005 when he and the mayor were still in good terms. When the relationship turned sour in 2006, these “numerators” were pulled out.

    But he said he still kept the copies of the payroll of these “ghost employees.”

    Lapu-Lapu City Vice Mayor Mario Amores, however, said he had not heard of any ghost employees at the City Hall even during the time when he was a member of the City Council.

    “I'm not familiar. Wa koy nasayran ana. We haven't received any complaint,” Amores told Cebu Daily News (CDN).

    Amores, an ally of Radaza, challenged Darnayla to bring his “serious” allegations to the proper forum. “Maayong iya nang ipursiger, kong tinuod man gani na, kay seryoso man nang iyang mga (It is better that he pursues it, if the accusations are true, because these are serious) allegations,” he said.

    Darnayla, who is on his last term as barangay captain, said 16 men were deployed to his barangay during the mayor's second term in 2004.

    These men did not have any clear job in Basak. Darnayla, however, could not explain why they were called as “numerators.”

    Darnayla, who is running for councilor in the October 29 barangay and Sangguniang Kabataan (youth council) elections, said these 16 would only go to the barangay during payday to sign their payroll and get their salary.

    In the payroll, he added, it showed that 16 men received P3,000 each but in reality, they only got P1,000 each.

    When he asked the City Hall's barangay affairs office where the P2,000 difference went, Darnayla said he was told that the rest of the amount was budgeted to another barangay. He said that while he didn't understand the explanation, he did not ask more questions.

    The 16 were pulled out in 2006 after the relationship between Darnayla and Radaza turned sour when the barangay captain led a group opposing a drainage project of the city in their barangay because it would trigger floods in their barangay and would also contaminate their water supply.

    Darnayla and two other barangay councilors were arrested when they led the barricade to stop the construction. The three were later released after the City Prosecutor's Office dismissed the sedition complaint filed against them.

    Darnayla told Cebu Daily News that he still has the copy of the payroll of these “ghost employees.”

    “Kompleto ko sa ebedensya, naa pa naku ang kopya sa payroll sa maong mga ghost employees,” (I have a complete evidence, I still have the copy of the payroll of the ghost employees) said Darnayla.

    He said he was willing to give these copies to the Visayas-Ombudsman should they heed his request for an investigation, as he said he believed these ghost employees still existed in the Radaza administration.

    The barangay captain also alleged that he heard from some of his neighbors that they were made to sign a payroll and then was given P500 each.

    Only three of the 30 barangays captains in Lapu-Lapu belong to the opposition. They are Darnayla, Angel Rodriguez of Punta Engaño and Eduardo Bensi of Calawisan.

    The 27 others gave a vote of confidence to Radaza amid the allegations raised against him, including the alleged overpriced purchase of 470 computer units worth P23.4 million in 2005.

    Association of Barangay Councils president Leo Mercado said they were willing to initiate actions to counter the protests raised by the mayor's critics.

    Darnayla, however, said he felt ashamed by the manifesto of support signed by the ABC in Lapu-Lapu.

    “Mauwaw ta uy. Sige ug suporta ana niya (Radaza) nga daghan og anomaliya. Ang nakadaut ana nila (ABC) nagsige ra man gud na sila og hangad ni Radaza para kuno sa kaayuhan sa ilang barangay (We should be ashamed. We continue to support Radaza despite the anomalies. The problem with them is that they continue to look up to Radaza for the good of their barangays),” Darnayla said.

    He said he was happy that businessman Efrain Pelaez Jr. exposed these alleged anomalies.

    “Maayo man nang mga negosyante kay dili man basta-basta – makabarug man gyud, kong yano lang gud nga mga tawo - dili man kaayo kasukol (The advantage of the businessmen is that they can stand on their own. If they were ordinary people, they would not be able to fight),” Darnayla said.

    He urged Pelaez, president of the Mactan Island Chamber of Commerce and Industry, to continue his crusade and not to be intimated by the moves of the mayor.

    Pelaez, through the Coralpoint Educational Foundation Inc., filed graft complaint against Radaza and 19 others for the alleged overpriced purchase of computers that were delivered to Lapu-Lapu public schools in 2005.

    Lapu-Lapu officials, however, hit back at Pelaez, calling him a tax evader who had failed to comply with business and real estate tax obligations in the city.

    A report from the Office of the Building Officials said the Marina Mall had no building, electrical, mechanical and plumbing permits.

    The tenants of the Pelaez-owned Marina Mall started to feel the heat as they were given notices giving them only 10 days to “show cause why their permit should not be revoked” for doing business in a mall without a building permit.

    Last Friday, the tenants received a letter from Alma Grace Ancla, HR/administrative officer of Pelaez' Coralpoint Properties Inc., asking them not to be worried, as their lawyers were working on the problem.

    “We would like to advice you to keep ready all your building permit applied/issued by the Office of the Building Official in (Philippine Export Processing Zone) and other permits should any surprise inspection will be made by the City Hall
    representatives,” according to the letter dated September 28.

    A tenant told CDN that they had nothing to do with the rift between Pelaez and Radaza.

    As far as they were concerned, she added, they had been paying their tax dues to the city government.
