    Default Mayor to Ban Motorcycles in SRP


    Maka-angayon ba kining huna-hunaa. Sama nako nga mag motor padung sa trabahoan nga mo agi ug SRP. Mangayu ko sa inyong mga opinion ug insakto ba kini? Salamat mga istoryan.

    i think the initial question would be:

    Does the mayor have the power to close a national public road? Although owned by cebu city gov't., wala may toll me so i assume it's still a public hiway... correct me if im wrong lang..

    for discussion lang ni ha....

    SRP was not created as a public hiway or as a national public road. wala toll fee kay its not created for transportation or travel much like the slex/nlex.

    SRP from its web site is a mix-area property of Cebu City for economic investment.... if i understand it correctly, mora ni peza or cebu business park nga gi create for a special purpose ---- which is i think not for public travel or transportation.
    The road is there for the locators ease of access to our sea port/airport.

    now...does the mayor of cebu have the power over its properties?

    Section 21. Closure and Opening of Roads. -

    (a) A local government unit may, pursuant to an ordinance, permanently or temporarily close or open any local road, alley, park, or square falling within its jurisdiction: Provided, however, That in case of permanent closure, such ordinance must be approved by at least two-thirds (2/3) of all the members of the sanggunian, and when necessary, an adequate substitute for the public facility that is subject to closure is provided.

    (b) No such way or place or any part thereof shall be permanently closed without making provisions for the maintenance of public safety therein. A property thus permanently withdrawn from public use may be used or conveyed for any purpose for which other real property belonging to the local government unit concerned may be lawfully used or conveyed: Provided, however, That no freedom park shall be closed permanently without provision for its transfer or relocation to a new site.

    (c) Any national or local road, alley, park, or square may be temporarily closed during an actual emergency, or fiesta celebrations, public rallies, agricultural or industrial fairs, or an undertaking of public works and highways, telecommunications, and waterworks projects, the duration of which shall be specified by the local chief executive concerned in a written order: Provided, however, That no national or local road, alley, park, or square shall be temporarily closed for athletic, cultural, or civic activities not officially sponsored, recognized, or approved by the local government unit concerned.

    (d) Any city, municipality, or barangay may, by a duly enacted ordinance, temporarily close and regulate the use of any local street, road, thoroughfare, or any other public place where shopping malls, Sunday, flea or night markets, or shopping areas may be established and where goods, merchandise, foodstuffs, commodities, or articles of commerce may be sold and dispensed to the general public.

    so, mura siyag private road owned by the city government?

    I think Rama needs DPWH ug LTO para mapatuman niya ang pag ban sa mga motor sa SRP..
    pero wala pud mo uyon si Dr. Tancinco of LTO ani nga plano ni Rama..

    kung matuman man gani ni, mo uyon pud ba kaha ang SM ug Lantaw diha.. tsk3x..

    that's the way i understand it kay part man sa property. I think there was a time na gi close ang srp ni osmena kay di paagi-on taga talisay kay naglalis man to sila sa ownership sa lot.

    well, based from the post above re Section 21, Rama needs to create an ordinance and approve by the city council para ma ban,close or partly prevent use of a road.

    mas maayo man gud istoryahon usa i-ban kay naa man daghan solution both long term and short term. drastic na sab kaayo na i-ban diretso.

    one thing nga ma tunhay gyud ni ang dalan dili lang sa srp kung di sa tibuok cebu is to really implement the rules and regulation and the proper issuance of drivers license --- walay fixers ug naa gyud actual driving test like sa gibuhat sa dmv sa us.
