Under the OMNIBUS RULES IMPLEMENTING THE LABOR CODE, BOOK FIVE
Labor Relations, RULE XIV Termination of Employment
SECTION 10: Certification of employment. — A dismissed worker shall be
entitled to receive, on request, a certificate from the employer specifying
the dates of his engagement and termination of his employment and the type or
types of work on which he is employed.
You can always demand for a certificate of employment. The IRR provides that a
dismissed employee can get his/her certificate of employment.
If until today the company is still refusing the request, we advise you to
visit our National Conciliation and Mediation Board (NCMB) located at G/F,
General Luna Wing, DOLE Bldg., San Jose Street, Intramuros , Manila. We will
invite your employer for conference under the Single Entry Approach (SEnA)
program of DOLE for possible amicable settlement.
