    Default Call to decentralize the Bar Examinations


    CEBU, Philippines - The call to decentralize the Bar Examinations is gaining ground as Senate President Franklin Drilon will sponsor a resolution urging the Supreme Court to hold the examinations also in the Visayas and Mindanao.

    But the former secretary of the Department of Justice said the Senate cannot legislate on this matter since it is under the exclusive jurisdiction of the Supreme Court.

    “I will sponsor a resolution for the Supreme Court to allow the holding of the examinations in the Visayas and Mindanao,” said Drilon in a press conference yesterday at the University of Cebu.

    Rule 138 (Attorneys and Admission to Bar), Section 11 of the Rules of Court, provides that the examinations for admission to the Bar of the Philippines shall take place annually in the City of Manila.

    Bar Examinations, touted as the country’s most difficult government examination, is done in four days.

    The University of Cebu-College of Law recently launched an online petition urging the Supreme Court to allow the decentralization of Bar Examinations.

    UC-College of Law Dean Baldomero Estenzo believed that more bar takers will pass if the exams are done outside Metro Manila since this would free them from the financial and psychological baggage.

    Estenzo and the rest of the law deans in the Visayas have filed a petition in 2010 asking the Supreme Court to also hold the Bar Exams in regional centers like Cebu.

    “The Senate will support this move,” Drilon assured.

    For the past four years, however, the High Court remains silent on this matter.

    Nice. Hopefully, when i take the bar exams soon, it will be here in Cebu. Kapoy rag adto Manila.

    pwede unta mang.hilabot ang legislative ug executive branches ani kay buot huna-hunaon it is for the good of every examinees man sad.

    maka.kuha pa ug dako nga pundo ang judicial branch tungod ani. at least, maka.kwarta sila bisan gamay lang. hehe

    Bisan unsaon sa senate ug botar ug Yes,
    bisan apil pa ang Executive wala gyud silay mahims ana.
    Lain kaayo paminawon nga mo-dictate na ang legislative sa judiciary kung unsay buhaton,
    kutob ra gyud sila sa proposal.

    Marquez described as “impossible” the proposal to hold the Bar outside Manila as the SC doesn’t have the money.

    “Marami ang kailangan i-consider dyan. (There are many things we have to consider). First and foremost, the court will have to ensure the integrity of the exams. I think that will have to be discussed and deliberated upon substantially,” he told reporters.

    Aside from budget constraints, Marquez earlier said the High Court is apprehensive against leakage during the transport of the test materials from Manila to the provinces. “I think we need to study about it well,” he said.
    Hmm. This call has been long overdue but SC still have no definite answer and still in study mode. Once this is okay, this could save money as this could lessen the financial burden for bar examinees and for their safety as well.

    In other words, Manila doesn't trust the rest of the Philippines. Therefore non-Manilenos must pay for plane tickets and lodging in order to get themselves tested in the only place where cheating isn't possible (i.e. Manila).

    Anyway, why stop with bar exams? De-centralize the board exams as well. If they don't trust the rest of the country to run bar exams, then they might as well require the rest of the Philippines to go to Manila to vote.

    And I thought a predominantly devout Catholic country would be such a trusting, loving society.

    yeah i know. mao nang ni.ingon ko -"pwede unta". all it takes is an amendment in the constitution and voila, decentralization!
